Bu nedenle i\u015f\u00e7i alacaklar\u0131n\u0131n hangi \u015fartlarda do\u011fdu\u011fu, nas\u0131l ispatlanaca\u011f\u0131 ve hangi s\u00fcrelerde talep edilebilece\u011fi b\u00fcy\u00fck \u00f6nem ta\u015f\u0131r.<\/p>\n<p><strong>\u0130\u015f\u00e7i Alacaklar\u0131 Ka\u00e7a Ayr\u0131l\u0131r?<\/strong><\/p>\n<p>\u0130\u015f\u00e7i alacaklar\u0131 genel olarak iki ba\u015fl\u0131k alt\u0131nda incelenebilir:<\/p>\n<p><strong>1. <\/strong>\u0130\u015f s\u00f6zle\u015fmesinin sona ermesine ba\u011fl\u0131 alacaklar<\/p>\n<p><strong>2.<\/strong> \u0130\u015f s\u00f6zle\u015fmesi devam ederken de talep edilebilecek alacaklar<\/p>\n<p>K\u0131dem tazminat\u0131, ihbar tazminat\u0131 ve kullan\u0131lmayan y\u0131ll\u0131k izin \u00fccreti kural olarak i\u015f s\u00f6zle\u015fmesinin sona ermesiyle g\u00fcndeme gelir. Buna kar\u015f\u0131l\u0131k \u00fccret, fazla \u00e7al\u0131\u015fma, hafta tatili ve ulusal bayram genel tatil \u00fccretleri i\u015f ili\u015fkisi devam ederken de talep edilebilir.<\/p>\n<p><strong>K\u0131dem Tazminat\u0131<\/strong><\/p>\n<p>K\u0131dem tazminat\u0131, i\u015f\u00e7inin ayn\u0131 i\u015fveren yan\u0131nda belirli bir s\u00fcre \u00e7al\u0131\u015fmas\u0131n\u0131n kar\u015f\u0131l\u0131\u011f\u0131 olarak kanunda \u00f6ng\u00f6r\u00fclen \u015fartlar\u0131n ger\u00e7ekle\u015fmesi halinde \u00f6denen tazminatt\u0131r.<\/p>\n<p>\u0130\u015f\u00e7inin k\u0131dem tazminat\u0131na hak kazanabilmesi i\u00e7in kural olarak en az bir y\u0131l \u00e7al\u0131\u015fm\u0131\u015f olmas\u0131 gerekir. Bunun yan\u0131nda i\u015f s\u00f6zle\u015fmesinin, i\u015f\u00e7i bak\u0131m\u0131ndan hakl\u0131 nedenle veya i\u015fveren bak\u0131m\u0131ndan haks\u0131z \u015fekilde sona ermi\u015f olmas\u0131 gerekir.<\/p>\n<p>\u0130\u015f\u00e7inin istifa etmesi halinde kural olarak k\u0131dem tazminat\u0131 hakk\u0131 do\u011fmaz. Ancak askerlik, emeklilik, kad\u0131n i\u015f\u00e7inin evlilik tarihinden itibaren bir y\u0131l i\u00e7inde i\u015ften ayr\u0131lmas\u0131, i\u015f\u00e7inin hakl\u0131 nedenle feshi gibi hallerde k\u0131dem tazminat\u0131 talep edilebilir.<\/p>\n<p>K\u0131dem tazminat\u0131, i\u015f\u00e7inin son br\u00fct \u00fccreti \u00fczerinden hesaplan\u0131r. D\u00fczenli nitelikteki yol, yemek, prim ve benzeri menfaatler de giydirilmi\u015f \u00fccret hesab\u0131nda dikkate al\u0131nabilir.<\/p>\n<p><strong>\u0130hbar Tazminat\u0131<\/strong><\/p>\n<p>Belirsiz s\u00fcreli i\u015f s\u00f6zle\u015fmelerinde taraflar, i\u015f s\u00f6zle\u015fmesini sona erdirmeden \u00f6nce kar\u015f\u0131 tarafa belirli s\u00fcrelerle bildirimde bulunmak zorundad\u0131r.<\/p>\n<p>\u0130hbar s\u00fcreleri;<\/p>\n<p>&#8211; 6 aydan az \u00e7al\u0131\u015fan i\u015f\u00e7i i\u00e7in 2 hafta,<\/p>\n<p>&#8211; 6 ay ile 1,5 y\u0131l aras\u0131 \u00e7al\u0131\u015fan i\u015f\u00e7i i\u00e7in 4 hafta,<\/p>\n<div data-channel=\"121\" data-advert=\"temedya\" data-rotation=\"120\" class=\"mb-3 text-center\"><\/div>\n<div data-channel=\"121\" data-advert=\"temedya\" data-rotation=\"120\" class=\"mb-3 text-center\"><\/div>\n<p>&#8211; 1,5 y\u0131l ile 3 y\u0131l aras\u0131 \u00e7al\u0131\u015fan i\u015f\u00e7i i\u00e7in 6 hafta,<\/p>\n<p>&#8211; 3 y\u0131ldan fazla \u00e7al\u0131\u015fan i\u015f\u00e7i i\u00e7in 8 haftad\u0131r.<\/p>\n<p>Bu s\u00fcrelere uyulmadan yap\u0131lan fesihlerde, bildirim s\u00fcresine ili\u015fkin \u00fccret tutar\u0131nda ihbar tazminat\u0131 g\u00fcndeme gelir.<\/p>\n<p>Hakl\u0131 nedenle derhal fesih halinde ise ihbar tazminat\u0131 talep edilemez.<\/p>\n<p><strong>\u00dccret Alaca\u011f\u0131<\/strong><\/p>\n<p>\u00dccret, i\u015f\u00e7inin eme\u011fi kar\u015f\u0131l\u0131\u011f\u0131nda i\u015fveren taraf\u0131ndan \u00f6denmesi gereken temel alacakt\u0131r. \u0130\u015fveren, i\u015f\u00e7inin \u00fccretini zaman\u0131nda ve eksiksiz \u00f6demekle y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p>\u00dccretin \u00f6denmedi\u011fi veya eksik \u00f6dendi\u011fi hallerde i\u015f\u00e7i, \u00f6denmeyen \u00fccretlerini talep edebilir. \u00dccretin \u00f6dendi\u011fini ispat y\u00fck\u00fc i\u015fverene aittir. Banka kay\u0131tlar\u0131, bordrolar, \u00fccret pusulalar\u0131 ve tan\u0131k beyanlar\u0131 uyu\u015fmazl\u0131klarda \u00f6nemli delil niteli\u011fi ta\u015f\u0131r.<\/p>\n<p>Ger\u00e7ek \u00fccretin bordroda g\u00f6sterilenden farkl\u0131 oldu\u011fu durumlarda i\u015f\u00e7i, fiili \u00fccretini tan\u0131k dahil her t\u00fcrl\u00fc delille ispatlayabilir.<\/p>\n<p><strong>Fazla \u00c7al\u0131\u015fma \u00dccreti<\/strong><\/p>\n<p>\u0130\u015f Kanunu&#8217;na g\u00f6re haftal\u0131k 45 saati a\u015fan \u00e7al\u0131\u015fmalar fazla \u00e7al\u0131\u015fma olarak kabul edilir. Fazla \u00e7al\u0131\u015fma yapan i\u015f\u00e7iye, her bir saat fazla \u00e7al\u0131\u015fma i\u00e7in normal saat \u00fccretinin y\u00fczde elli art\u0131r\u0131lm\u0131\u015f hali \u00f6denmelidir.<\/p>\n<p>Fazla \u00e7al\u0131\u015fma alacaklar\u0131nda i\u015f\u00e7i, fazla \u00e7al\u0131\u015fma yapt\u0131\u011f\u0131n\u0131 ispatlamakla y\u00fck\u00fcml\u00fcd\u00fcr. \u0130\u015fveren ise fazla \u00e7al\u0131\u015fma \u00fccretinin \u00f6dendi\u011fini yaz\u0131l\u0131 delillerle ispatlamal\u0131d\u0131r.<\/p>\n<p>Uygulamada fazla mesai alacaklar\u0131nda i\u015fyeri \u00e7al\u0131\u015fma d\u00fczeni, giri\u015f-\u00e7\u0131k\u0131\u015f kay\u0131tlar\u0131, puantajlar, bordrolar ve tan\u0131k anlat\u0131mlar\u0131 \u00f6nem ta\u015f\u0131r.<\/p>\n<p><strong>Hafta Tatili \u00dccreti<\/strong><\/p>\n<p>\u0130\u015f\u00e7inin haftal\u0131k \u00e7al\u0131\u015fma s\u00fcresini tamamlamas\u0131 halinde hafta tatiline hak kazanmas\u0131 gerekir. Hafta tatili kural olarak kesintisiz en az 24 saat dinlenme hakk\u0131d\u0131r.<\/p>\n<p>\u0130\u015f\u00e7i hafta tatilinde \u00e7al\u0131\u015ft\u0131r\u0131lm\u0131\u015fsa, bu \u00e7al\u0131\u015fmas\u0131n\u0131n kar\u015f\u0131l\u0131\u011f\u0131n\u0131 ayr\u0131ca talep edebilir. Hafta tatilinde \u00e7al\u0131\u015f\u0131ld\u0131\u011f\u0131n\u0131 ispat y\u00fck\u00fc i\u015f\u00e7ide, \u00fccretin \u00f6dendi\u011fini ispat y\u00fck\u00fc ise i\u015fverendedir.<\/p>\n<p><strong>Ulusal Bayram ve Genel Tatil \u00dccreti<\/strong><\/p>\n<p>Ulusal bayram ve genel tatil g\u00fcnlerinde \u00e7al\u0131\u015fan i\u015f\u00e7i, \u00e7al\u0131\u015ft\u0131\u011f\u0131 her g\u00fcn i\u00e7in ayr\u0131ca bir g\u00fcnl\u00fck \u00fccrete hak kazan\u0131r.<\/p>\n<p>Bu alacak kalemi uygulamada \u00f6zellikle resmi tatillerde, dini bayramlarda, y\u0131lba\u015f\u0131, 1 May\u0131s, 15 Temmuz, 30 A\u011fustos ve 29 Ekim gibi g\u00fcnlerde \u00e7al\u0131\u015fan i\u015f\u00e7iler bak\u0131m\u0131ndan \u00f6nemlidir.<\/p>\n<p>\u0130\u015f\u00e7i bu g\u00fcnlerde \u00e7al\u0131\u015ft\u0131\u011f\u0131n\u0131 ispatlad\u0131\u011f\u0131nda, i\u015fveren \u00f6demenin yap\u0131ld\u0131\u011f\u0131n\u0131 belgelemek zorundad\u0131r.<\/p>\n<p><strong>Y\u0131ll\u0131k \u0130zin \u00dccreti<\/strong><\/p>\n<p>Y\u0131ll\u0131k \u00fccretli izin, i\u015f\u00e7inin dinlenme hakk\u0131n\u0131n bir sonucudur. \u0130\u015fveren, i\u015f\u00e7iye y\u0131ll\u0131k izin hakk\u0131n\u0131 fiilen kulland\u0131rmakla y\u00fck\u00fcml\u00fcd\u00fcr.<\/p>\n<p>\u0130\u015f ili\u015fkisi devam ederken y\u0131ll\u0131k izin hakk\u0131n\u0131n paraya \u00e7evrilmesi m\u00fcmk\u00fcn de\u011fildir. Ancak i\u015f s\u00f6zle\u015fmesi sona erdi\u011finde, kullan\u0131lmayan y\u0131ll\u0131k izin s\u00fcreleri \u00fccret alaca\u011f\u0131na d\u00f6n\u00fc\u015f\u00fcr.<\/p>\n<p>Y\u0131ll\u0131k izinlerin kulland\u0131r\u0131ld\u0131\u011f\u0131n\u0131 ispat y\u00fck\u00fc i\u015fverene aittir. Bu nedenle i\u015fverenin imzal\u0131 izin formlar\u0131, izin defterleri veya e\u015fde\u011fer yaz\u0131l\u0131 belgelerle ispat yapmas\u0131 gerekir.<\/p>\n<p><strong>\u0130\u015f\u00e7i Alacaklar\u0131nda Zamana\u015f\u0131m\u0131<\/strong><\/p>\n<p>\u0130\u015f\u00e7i alacaklar\u0131nda zamana\u015f\u0131m\u0131 s\u00fcresi alaca\u011f\u0131n t\u00fcr\u00fcne g\u00f6re de\u011ferlendirilir. 7036 say\u0131l\u0131 \u0130\u015f Mahkemeleri Kanunu ile k\u0131dem tazminat\u0131, ihbar tazminat\u0131, y\u0131ll\u0131k izin \u00fccreti, k\u00f6t\u00fc niyet tazminat\u0131 ve e\u015fit davranma ilkesine ayk\u0131r\u0131l\u0131ktan kaynaklanan tazminatlar bak\u0131m\u0131ndan zamana\u015f\u0131m\u0131 s\u00fcresi be\u015f y\u0131l olarak d\u00fczenlenmi\u015ftir.<\/p>\n<p>\u00dccret, fazla \u00e7al\u0131\u015fma, hafta tatili ve ulusal bayram genel tatil \u00fccretleri bak\u0131m\u0131ndan da genel olarak be\u015f y\u0131ll\u0131k zamana\u015f\u0131m\u0131 s\u00fcresi uygulan\u0131r.<\/p>\n<p>Bu nedenle i\u015f\u00e7i alacaklar\u0131n\u0131n zaman\u0131nda talep edilmesi, hak kayb\u0131 ya\u015fanmamas\u0131 bak\u0131m\u0131ndan son derece \u00f6nemlidir.<\/p>\n<p><strong>\u0130\u015f\u00e7i Alacaklar\u0131nda Arabuluculuk \u015eart\u0131<\/strong><\/p>\n<p>\u0130\u015f\u00e7i alacaklar\u0131na ili\u015fkin davalarda arabuluculuk dava \u015fart\u0131d\u0131r. Bu nedenle i\u015f\u00e7i, do\u011frudan i\u015f mahkemesinde dava a\u00e7madan \u00f6nce arabulucuya ba\u015fvurmal\u0131d\u0131r.<\/p>\n<p>Arabuluculuk s\u00fcreci tamamlanmadan dava a\u00e7\u0131lmas\u0131 halinde dava, dava \u015fart\u0131 yoklu\u011fu nedeniyle usulden reddedilebilir.<\/p>\n<p>Arabuluculuk son tutana\u011f\u0131nda hangi alacak kalemlerinin yer ald\u0131\u011f\u0131na dikkat edilmelidir. \u00c7\u00fcnk\u00fc dava a\u00e7\u0131l\u0131rken talep edilecek alacaklar\u0131n arabuluculuk s\u00fcrecinde de konu edilmi\u015f olmas\u0131 gerekir.<\/p>\n<p><strong>Sonu\u00e7<\/strong><\/p>\n<p>\u0130\u015f\u00e7i alacaklar\u0131, i\u015f ili\u015fkisinin hem devam\u0131 s\u0131ras\u0131nda hem de sona ermesinden sonra g\u00fcndeme gelebilen \u00f6nemli haklard\u0131r. Her alacak kaleminin do\u011fum \u015fart\u0131, ispat y\u00f6ntemi ve hesaplama bi\u00e7imi farkl\u0131d\u0131r.<\/p>\n<p>Bu nedenle i\u015f\u00e7ilik alacaklar\u0131na ili\u015fkin uyu\u015fmazl\u0131klarda yaln\u0131zca alaca\u011f\u0131n varl\u0131\u011f\u0131 de\u011fil; fesih \u015fekli, \u00e7al\u0131\u015fma s\u00fcresi, ger\u00e7ek \u00fccret, bordro kay\u0131tlar\u0131, tan\u0131k beyanlar\u0131 ve zamana\u015f\u0131m\u0131 s\u00fcreleri birlikte de\u011ferlendirilmelidir.<\/p>\n<p>Hak kayb\u0131 ya\u015fanmamas\u0131 i\u00e7in i\u015f\u00e7i ve i\u015fverenlerin s\u00fcreci hukuki destek alarak y\u00fcr\u00fctmesi \u00f6nem ta\u015f\u0131maktad\u0131r.<\/p>\n<p><a href=\"https:\/\/www.hukukihaber.net\/av-elif-coskun\" title=\"Av.
