CEVAP<\/strong><br \/>\nAs\u0131l ve birle\u015fen davada daval\u0131 &#8230;\u015e. vekili cevap dilek\u00e7esinde; davac\u0131lar ile y\u00fcklenici \u015firket aras\u0131nda d\u00fczenlendi\u011fi iddia edilen arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmelerinin tapuya \u015ferh edilmemi\u015f oldu\u011funu, m\u00fcvekkili bankan\u0131n iyiniyetle tapu siciline itimat ederek, y\u00fckleniciye kulland\u0131rd\u0131\u011f\u0131 kredinin teminat\u0131 olmak \u00fczere s\u00f6z konusu ipote\u011fi tesis ettirdi\u011fini, davac\u0131lar ile y\u00fcklenici \u015firket aras\u0131ndaki hukuki ili\u015fkilerden haberdar olmad\u0131\u011f\u0131n\u0131 savunarak, davan\u0131n reddini istemi\u015ftir.<\/p>\n<p>As\u0131l ve birle\u015fen davada di\u011fer bir k\u0131s\u0131m daval\u0131lar vekilleri, tapu k\u00fct\u00fc\u011f\u00fcnde arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi \u015ferhi bulunmad\u0131\u011f\u0131n\u0131, y\u00fckleniciden olan alacaklar\u0131n\u0131n tahsili amac\u0131yla giri\u015ftikleri icra takiplerinde, ta\u015f\u0131nmaz\u0131n tapu kayd\u0131na haciz \u015ferhleri i\u015flendi\u011fini savunarak, davalar\u0131n reddini istemi\u015flerdir.<\/p>\n<p>As\u0131l ve birle\u015fen davada daval\u0131 y\u00fcklenici &#8230; M\u00fch. Har. \u0130n\u015f&#8230; Ltd. \u015eti. cevap dilek\u00e7esi sunmam\u0131\u015ft\u0131r.<\/p>\n<p><strong>III. \u0130LK DERECE MAHKEMES\u0130 KARARI<\/strong><br \/>\n\u0130lk Derece Mahkemesinin yukar\u0131da tarih ve say\u0131s\u0131 belirtilen karar\u0131 ile as\u0131l ve birle\u015fen davada davac\u0131lar ile daval\u0131 y\u00fcklenici &#8230; M\u00fch. Har. \u0130n\u015f&#8230; Ltd. \u015eti. aras\u0131nda d\u00fczenlenen arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmelerinde, i\u015fin s\u00fcresinin ruhsattan itibaren 2 y\u0131l olarak belirlendi\u011fi, davac\u0131 arsa sahiplerinin s\u00f6zle\u015fmelere konu ta\u015f\u0131nmazlar\u0131 y\u00fcklenici \u015firkete tapuda devrettikleri, y\u00fcklenicinin in\u015faat ruhsat\u0131 ba\u015fvurusu yapmad\u0131\u011f\u0131, herhangi bir in\u015faat faaliyetinde bulunmad\u0131\u011f\u0131, bu nedenle davac\u0131 arsa sahiplerinin s\u00f6zle\u015fmenin geriye etkili feshi ve tapu iptal tescil taleplerinde hakl\u0131 olduklar\u0131, y\u00fcklenici \u015firket, arsa sahiplerine kar\u015f\u0131 t\u00fcm edimlerini yerine getirerek kendisine avans olarak verilen tapuya hak kazanamad\u0131\u011f\u0131ndan, y\u00fcklenicinin bor\u00e7lar\u0131 nedeniyle di\u011fer daval\u0131lar lehine ta\u015f\u0131nmaz\u0131n tapu kayd\u0131na konulan ipotek ve hacizlerin dayana\u011f\u0131n\u0131n kalmad\u0131\u011f\u0131, ipotek ve haciz sahibi di\u011fer daval\u0131lar\u0131n iyiniyet iddialar\u0131n\u0131n dinlenme olana\u011f\u0131 bulunmad\u0131\u011f\u0131 gerek\u00e7esiyle, as\u0131l ve birle\u015fen davan\u0131n kabul\u00fc ile arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmelerinin geriye etkili olarak feshine, dava konusu ta\u015f\u0131nmaz\u0131n tapu kayd\u0131n\u0131n iptali ile hisseleri oran\u0131nda davac\u0131lar ad\u0131na tesciline, ta\u015f\u0131nmaz\u0131n tapu kayd\u0131na, daval\u0131 &#8230;\u015e. lehine tesis edilen ipote\u011fin ve di\u011fer daval\u0131lar lehine konulan hacizlerin kald\u0131r\u0131lmas\u0131na karar verilmi\u015ftir.<\/p>\n<p><strong>IV. \u0130ST\u0130NAF<\/strong><br \/>\n\u0130lk Derece Mahkemesinin yukar\u0131da belirtilen karar\u0131na kar\u015f\u0131 s\u00fcresi i\u00e7inde daval\u0131lar &#8230;, &#8230; Yat\u0131r\u0131m \u0130zleme ve Koordinosyan Ba\u015fkanl\u0131\u011f\u0131, &#8230; A.\u015e., &#8230; Bankas\u0131 A.\u015e., &#8230; Varl\u0131k Y\u00f6netim A.\u015e., Sosyal G\u00fcvenlik Kurumu Ba\u015fkanl\u0131\u011f\u0131, &#8230; Bankas\u0131 A.\u015e., &#8230; Bankas\u0131 A.\u015e. vekilleri taraf\u0131ndan istinaf ba\u015fvurusunda bulunulmas\u0131 \u00fczerine, B\u00f6lge Adliye Mahkemesinin yukar\u0131da tarih ve say\u0131s\u0131 belirtilen karar\u0131 ile istinaf ba\u015fvurular\u0131n\u0131n esastan reddine karar verilmi\u015ftir.<\/p>\n<p>\n<strong>V. TEMY\u0130Z<\/strong><br \/>\nA. Temyiz Sebepleri<br \/>\nAs\u0131l ve birle\u015fen davada daval\u0131 &#8230;\u015e. vekili temyiz dilek\u00e7esinde;<\/p>\n<p>a. Zorunlu arabuluculuk \u015fart\u0131n\u0131n yerine getirilmedi\u011fini,<\/p>\n<p>b. Davan\u0131n zamana\u015f\u0131m\u0131na u\u011frad\u0131\u011f\u0131n\u0131,<\/p>\n<p>c. Davada ticaret mahkemesinin g\u00f6revli oldu\u011funu,<\/p>\n<p>d. Davac\u0131n\u0131n yeterli teminat g\u00f6stermedi\u011fini,<\/p>\n<p>e. \u0130potek bedeli \u00fczerinden har\u00e7 yat\u0131r\u0131lmad\u0131\u011f\u0131n\u0131,<\/p>\n<p>f. Birle\u015fen davaya konu arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesinin, adi yaz\u0131l\u0131 \u015fekilde d\u00fczenlendi\u011finden ge\u00e7ersiz oldu\u011funu,<\/p>\n<p>g. Tapu sicilinde arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi \u015ferhi bulunmad\u0131\u011f\u0131n\u0131, tapu sicilindeki kayda g\u00fcvenerek, kay\u0131t maliki y\u00fcklenici \u015firkete kulland\u0131r\u0131lan kredinin teminat\u0131 olmak \u00fczere, s\u00f6z konusu ipote\u011fin tesis edildi\u011fini, m\u00fcvekkili bankan\u0131n iyiniyetli oldu\u011funu, TMK&#8217;n\u0131n 1023. maddesi uyar\u0131nca iyiniyetinin korunmas\u0131 gerekti\u011fini, davac\u0131lar ile y\u00fcklenici \u015firket aras\u0131ndaki hukuki ili\u015fkilerden haberdar olmad\u0131\u011f\u0131n\u0131, bunlar\u0131 ara\u015ft\u0131rma y\u00fck\u00fcml\u00fcl\u00fc\u011f\u00fc de bulunmad\u0131\u011f\u0131n\u0131, ta\u015f\u0131nmaz\u0131n arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesine konu oldu\u011funu bilmedi\u011fini, bilmesinin de m\u00fcmk\u00fcn olmad\u0131\u011f\u0131n\u0131,<\/p>\n<p>h. S\u00f6zle\u015fmeyi tapu \u015ferh ettirmeyen davac\u0131 arsa sahiplerinin kusurlu olduklar\u0131n\u0131, kar\u015f\u0131 akidleri olan y\u00fcklenici \u015firkete kar\u015f\u0131 ileri s\u00fcrebilecekleri \u015fahsi haklar\u0131n\u0131, ayni hak sahibi bankaya kar\u015f\u0131 ileri s\u00fcremeyeceklerini,<\/p>\n<p>\u0131. Davan\u0131n a\u00e7\u0131lmas\u0131na sebebiyet vermedi\u011finden m\u00fcvekkili aleyhine yarg\u0131lama giderleri ve vekalet \u00fccretine h\u00fckmedilmesinin do\u011fru olmad\u0131\u011f\u0131n\u0131 beyan etmektedir.<\/p>\n<p>B. De\u011ferlendirme ve Gerek\u00e7e<br \/>\nUyu\u015fmazl\u0131k, arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesinin geriye etkili feshi nedeniyle tapu iptal tescil ile ipote\u011fin ve hacizlerin kald\u0131r\u0131lmas\u0131 istemlerine ili\u015fkindir.<\/p>\n<p>Dairemizin, \u201carsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesinin geriye etkili feshi halinde y\u00fckleniciden hisse veya ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm sat\u0131n alan yahut lehine ipotek tesis edilen \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin iyiniyetle tapuya g\u00fcvenerek ayni hak iktisaplar\u0131n\u0131n dinlenmeyece\u011fine..\u201d dair i\u00e7tihad\u0131ndan d\u00f6nmek amac\u0131yla Yarg\u0131tay Kanunu\u2019nun 15\/2-c maddesi gere\u011fince Yarg\u0131tay Birinci Ba\u015fkanl\u0131\u011f\u0131na yapt\u0131\u011f\u0131 ba\u015fvuru neticesinde Yarg\u0131tay \u0130\u00e7tihatlar\u0131 Birle\u015ftirme B\u00fcy\u00fck Genel Kurulunca 16.05.2025 tarihli, 2024\/1 Esas, 2025\/2 Karar say\u0131l\u0131 \u0130\u00e7tihad\u0131 Birle\u015ftirme Karar\u0131 ile Dairemizin eski i\u00e7tihatlar\u0131ndan d\u00f6nme istemi kabul edilmi\u015ftir.<\/p>\n<p>16.05.2025 tarih, 2024\/1 Esas; 2025\/2 Karar say\u0131l\u0131 \u0130\u00e7tihad\u0131 Birle\u015ftirme Karar\u0131nda belirtildi\u011fi gibi, Yarg\u0131tay Kanunu\u2019nun 45\/5. f\u0131kras\u0131 gere\u011fince i\u00e7tihad\u0131 birle\u015ftirme kararlar\u0131 benzer hukuki konularda Yarg\u0131tay Genel Kurullar\u0131n\u0131, dairelerini ve adliye mahkemelerini ba\u011flar. \u0130\u00e7tihad\u0131 birle\u015ftirme \u00f6ncesinde aksi y\u00f6nde bir bozma olsa bile usuli kazan\u0131lm\u0131\u015f hakk\u0131n istisnas\u0131 olarak uygulanmas\u0131 gerekir.<\/p>\n<div data-channel=\"121\" data-advert=\"temedya\" data-rotation=\"120\" class=\"mb-3 text-center\"><\/div>\n<div data-channel=\"121\" data-advert=\"temedya\" data-rotation=\"120\" class=\"mb-3 text-center\"><\/div>\n<p>Bu nedenle;<br \/>\nHukuk sistemimizde ta\u015f\u0131nmaz m\u00fclkiyeti edinmek ancak tapu sicili ile m\u00fcmk\u00fcnd\u00fcr. Tapu sicili herkese a\u00e7\u0131kt\u0131r. \u0130lgili herkes, tapu k\u00fct\u00fc\u011f\u00fcndeki ilgili sayfa ve belgelerin kendisine g\u00f6sterilmesini veya bunlar\u0131n \u00f6rneklerinin verilmesini tapu memurundan isteyebilir. Tapu k\u00fct\u00fc\u011f\u00fcne yap\u0131lm\u0131\u015f her tescil, bir ayni hakk\u0131 kar\u015f\u0131lar. Ge\u00e7erli bir tescil, sicil d\u0131\u015f\u0131 meydana gelen bir de\u011fi\u015fiklik sonucu sonradan yolsuz tescil haline gelebilir. Bu durumda bile iyi niyetli \u00fc\u00e7\u00fcnc\u00fc ki\u015filer bak\u0131m\u0131ndan, tescilin olumlu h\u00fckm\u00fc uygulan\u0131r. Yani, iyi niyetli \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin b\u00f6yle bir tescile g\u00fcvenerek kazand\u0131klar\u0131 ayni haklar korunur (TMK. m. 1023).<\/p>\n<p>Arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi, b\u00fcnyesinde gayrimenkul sat\u0131\u015f vaadi ve eser s\u00f6zle\u015fmesini bar\u0131nd\u0131ran karma bir s\u00f6zle\u015fmedir. Bu s\u00f6zle\u015fmede arsa sahibi, s\u00f6zle\u015fmeye uygun ko\u015fullarda arsas\u0131n\u0131 y\u00fckleniciye teslim etmek; y\u00fcklenici kendisine kar\u015f\u0131 edimini yerine getirdi\u011finde ise y\u00fckleniciye b\u0131rak\u0131lan ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin tapusunu ona devretmek ile y\u00fck\u00fcml\u00fcd\u00fcr. S\u00f6zle\u015fmenin di\u011fer taraf\u0131 olan y\u00fcklenicinin edim borcu ise s\u00f6zle\u015fmede kararla\u015ft\u0131r\u0131lan nitelikteki binay\u0131 yap\u0131p arsa sahibine teslim etmektir. Ayn\u0131 zamanda arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi ani edimli bir s\u00f6zle\u015fmedir. Ani edimli s\u00f6zle\u015fmenin kural olarak geriye etkili feshi ve tasfiyesi m\u00fcmk\u00fcnd\u00fcr. Geriye etkili fesihte s\u00f6zle\u015fmenin taraflar\u0131 verdiklerini sebepsiz zenginle\u015fme kurallar\u0131na g\u00f6re geri isteyebilirler. Uygulamada arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi yap\u0131ld\u0131ktan sonra y\u00fcklenici hen\u00fcz edimlerini yerine getirmeden; arsa sahibi, arsa veya kat irtifak tapular\u0131n\u0131 veya bir k\u0131sm\u0131n\u0131 \u00e7e\u015fitli saiklerle y\u00fckleniciye tapuda devretmekte ve y\u00fcklenici devrald\u0131\u011f\u0131 ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm veya arsa hisselerini \u00fc\u00e7\u00fcnc\u00fc ki\u015filere satmaktad\u0131r. Arsa pay\u0131 veya ba\u011f\u0131ms\u0131z b\u00f6l\u00fcmlerin sat\u0131lmas\u0131ndan sonra y\u00fcklenici edimlerini yerine getirmedi\u011fi i\u00e7in s\u00f6zle\u015fmenin geriye etkili feshi talep edilebilmektedir.<\/p>\n<p>TMK\u2019n\u0131n 3. maddesine g\u00f6re, tapuya g\u00fcvendi\u011fini, iyi niyetli oldu\u011funu beyan eden ve y\u00fckleniciden arsa pay\u0131 veya ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm sat\u0131n alan \u00fc\u00e7\u00fcnc\u00fc ki\u015finin iyiniyetli oldu\u011fu Kanun gere\u011fince karine olarak kabul edilmelidir. Ayn\u0131 Kanunun 1023. maddesine g\u00f6re ise tapuya g\u00fcvenerek iktisap edilen ayni hakk\u0131n korunmas\u0131 gerekir.<\/p>\n<p>TMK\u2019n\u0131n 3. ve 1023. maddelerine g\u00f6re, y\u00fckleniciden arsa pay\u0131 veya ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm devralan \u00fc\u00e7\u00fcnc\u00fc ki\u015fi iyi niyetli ise y\u00fcklenici ad\u0131na yap\u0131lan tescil ba\u015flang\u0131\u00e7tan itibaren yolsuz olsa veya sonradan geriye etkili fesihle yolsuz h\u00e2le gelse bile devrin ge\u00e7erli olaca\u011f\u0131 kabul edilmelidir. Zira tapu siciline g\u00fcven ilkesi korunmazsa hukuk\u00ee i\u015flem g\u00fcvenli\u011fi, dolay\u0131s\u0131yla hukukun en temel ilkelerinden olan hukuk\u00ee g\u00fcvenlik ilkesi de ihl\u00e2l edilmi\u015f olur.<\/p>\n<p>Arsa sahibinin; \u00fc\u00e7\u00fcnc\u00fc ki\u015finin ta\u015f\u0131nmaz\u0131 tapuda sat\u0131n ald\u0131\u011f\u0131 anda arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi nedeniyle tapunun y\u00fckleniciye devredildi\u011fini ve y\u00fcklenicinin edimlerini yerine getirmedi\u011fi i\u00e7in s\u00f6zle\u015fmenin geriye etkili feshi ihtimalini bildi\u011fini ve buna ra\u011fmen ta\u015f\u0131nmaz\u0131 sat\u0131n ald\u0131\u011f\u0131n\u0131 veya lehine ipotek tesis etti\u011fini bir ba\u015fka deyi\u015fle \u00fc\u00e7\u00fcnc\u00fc ki\u015finin k\u00f6t\u00fc niyetli oldu\u011funu somut delil ve vak\u0131alarla ispat etmesi halinde elbette tapunun arsa sahibine d\u00f6nece\u011finin kabul\u00fc gerekir.<\/p>\n<p>\u00d6te yandan, arsa sahibinin y\u00fckleniciye devretti\u011fi tapunun avans tapu oldu\u011funun kabul\u00fc de m\u00fcmk\u00fcn de\u011fildir. Zira \u201cavans tapu\u201d kavram\u0131n\u0131n T\u00fcrk Medeni Kanunu ve T\u00fcrk E\u015fya Hukuku sisteminde yerinin bulunmad\u0131\u011f\u0131, Doktrinde de belirtildi\u011fi gibi, arsa sahibinin y\u00fckleniciye tapu devrinin avans tapu kavram\u0131yla a\u00e7\u0131klanamayaca\u011f\u0131, zira tapu devrinin \u015farta ba\u011flanamayaca\u011f\u0131; dolay\u0131s\u0131yla, y\u00fcklenici ad\u0131na kay\u0131tl\u0131 olan arsa hissesi veya ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fcn \u00fc\u00e7\u00fcnc\u00fc ki\u015fiye sat\u0131lmas\u0131n\u0131n ge\u00e7erli oldu\u011fu kabul edilmelidir.<\/p>\n<p>Arsa sahibinin y\u00fckleniciye tapuyu devretmesi, yolsuz tescil olarak da de\u011ferlendirilemez. Zira ayn\u00ee hakk\u0131n kurulabilmesi i\u00e7in yeterli olmayan ve ger\u00e7ek hak sahipli\u011fini yans\u0131tmayan tescil, yolsuz tescildir. (TMK.1024). TMK\u2019n\u0131n 992. maddesi h\u00fckm\u00fc gere\u011fince, arsa sahibinin bozucu yenilik do\u011furan hakk\u0131n\u0131 kullanarak s\u00f6zle\u015fmeden d\u00f6nme an\u0131na kadar, m\u00fclkiyet hakk\u0131na sahip y\u00fcklenicinin tasarruf i\u015fleminde hi\u00e7 bir hukuki sakatl\u0131k olmayacakt\u0131r. Arsa sahibi, s\u00f6zle\u015fmeden sonradan d\u00f6nse bile \u201cyolsuz tescil\u201d iddias\u0131yla y\u00fckleniciden iyi niyetle ayni hak iktisap eden \u00fc\u00e7\u00fcnc\u00fc ki\u015fiden tapu iptali ve tescil talep ya da ipote\u011fin kald\u0131r\u0131lmas\u0131n\u0131 talep etme hakk\u0131 bulunmayacakt\u0131r.<\/p>\n<p>\u0130zah edilen nedenlerle, tapuya g\u00fcvenerek y\u00fckleniciden arsa hissesi veya ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm sat\u0131n alan yahut lehine ipotek tesis edilen iyi niyetli \u00fc\u00e7\u00fcnc\u00fc ki\u015finin TMK&#8217;n\u0131n 1023. maddesine istinaden iktisab\u0131n\u0131n korunmas\u0131 gerekir. Ancak, arsa sahibinin TMK\u2019n\u0131n 3\/2.f\u0131kras\u0131 gere\u011fince, \u00fc\u00e7\u00fcnc\u00fc ki\u015finin ta\u015f\u0131nmaz\u0131 sat\u0131n ald\u0131\u011f\u0131 veya lehine ipotek tesis etti\u011fi anda, \u201ctapunun arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi gere\u011fince y\u00fckleniciye devredildi\u011fini ve s\u00f6zle\u015fmenin geriye etkili fesih ko\u015fullar\u0131n\u0131n bulundu\u011funu\u201d bildi\u011fini veya bilmesi gerekti\u011fini ispatlamas\u0131 halinde arsa sahibinin tapu iptali ve tescil ya da ipote\u011fin kald\u0131r\u0131lmas\u0131 talebi kabul edilebilir.<\/p>\n<p>An\u0131lan \u0130\u00e7tihad\u0131 Birle\u015ftirme ve Dairemizin yeni i\u00e7tihatlar\u0131 do\u011frultusunda Mahkemece yap\u0131lacak i\u015f; daval\u0131 &#8230;\u015e.\u2019nin yarg\u0131lama a\u015famas\u0131ndaki savunmalar\u0131nda s\u00f6z konusu ipote\u011fin tesisi s\u0131ras\u0131nda iyiniyetli oldu\u011funu, davac\u0131 arsa sahipleri ile daval\u0131 y\u00fcklenici aras\u0131ndaki arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesinden haberdar olmad\u0131\u011f\u0131n\u0131 savundu\u011fundan, daval\u0131 bankan\u0131n ipote\u011fin tesisi an\u0131nda k\u00f6t\u00fcniyetli oldu\u011funun ispat\u0131 konusunda, as\u0131l ve birle\u015fen davada davac\u0131 arsa sahiplerinin delillerinin ibraz\u0131n\u0131n sa\u011flanmas\u0131, ibraz edilecek deliller ile birlikte dosya aras\u0131nda bulunan t\u00fcm bilgi ve belgeler birlikte incelenerek sonucuna uygun karar verilmesidir.<\/p>\n<p>Bozma sebebine g\u00f6re daval\u0131 &#8230;\u015e. vekillinin di\u011fer temyiz itirazlar\u0131n\u0131n bu a\u015famada de\u011ferlendirilmesine gerek g\u00f6r\u00fclmemi\u015ftir.<\/p>\n<p><strong>VI.
