Yerle\u015fik i\u00e7tihada g\u00f6re, arsa sahibinin y\u00fckleniciye yapt\u0131\u011f\u0131 tapu devri &#8220;avans niteli\u011finde&#8221; kabul edilmekte; s\u00f6zle\u015fmenin geriye etkili olarak feshi veya ge\u00e7ersizli\u011finin tespiti halinde, y\u00fckleniciden ta\u015f\u0131nmaz edinen \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin TMK m.1023 kapsam\u0131nda korunamayaca\u011f\u0131 benimsenmekteydi. Bu nedenle \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin iyiniyetli olup olmad\u0131\u011f\u0131 \u00e7o\u011fu zaman ayr\u0131ca ara\u015ft\u0131r\u0131lmaks\u0131z\u0131n, ta\u015f\u0131nmazlar\u0131n arsa sahibine d\u00f6nmesi gerekti\u011fi kabul edilmekteydi.<\/p>\n<p>Ancak<a href=\"https:\/\/hukukihabernet.teimg.com\/hukukihaber-net\/uploads\/2026\/06\/yargitay-ictihadi-birlestirme-buyuk-genel-kurulu-2024-1-e-2025-2-k.pdf\" rel=\"dofollow\"> <strong>Yarg\u0131tay \u0130\u00e7tihad\u0131 Birle\u015ftirme B\u00fcy\u00fck Genel Kurulu&#8217;nun 16.05.2025 tarihli, E.2024\/1, K.2025\/2 say\u0131l\u0131 karar\u0131<\/strong><\/a>, bu yerle\u015fik yakla\u015f\u0131m\u0131 de\u011fi\u015ftirmi\u015ftir. Kurul, tapu siciline g\u00fcven ilkesini esas alarak \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin iyiniyetli oldu\u011funun as\u0131l oldu\u011funu, k\u00f6t\u00fcniyetin ise bunu iddia eden arsa sahibi taraf\u0131ndan somut delillerle ispatlanmas\u0131 gerekti\u011fini kabul etmi\u015ftir. B\u00f6ylece y\u00fckleniciden ta\u015f\u0131nmaz edinmi\u015f olman\u0131n tek ba\u015f\u0131na \u00fc\u00e7\u00fcnc\u00fc ki\u015fiyi k\u00f6t\u00fcniyetli h\u00e2le getirmeyece\u011fi; iyiniyetli \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin TMK m.1023 kapsam\u0131nda korunaca\u011f\u0131, ancak somut olayda k\u00f6t\u00fcniyetin ispatlanmas\u0131 halinde ta\u015f\u0131nmaz\u0131n arsa sahibine d\u00f6nebilece\u011fi sonucuna ula\u015f\u0131lm\u0131\u015ft\u0131r.<\/p>\n<p>Bu karar, arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmelerinden kaynaklanan uyu\u015fmazl\u0131klarda \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin hukuki durumuna ili\u015fkin k\u00f6kl\u00fc bir de\u011fi\u015fiklik yaratm\u0131\u015ft\u0131r. \u0130\u00e7tihad\u0131 Birle\u015ftirme Karar\u0131 sonras\u0131nda art\u0131k yaln\u0131zca y\u00fckleniciden do\u011frudan ta\u015f\u0131nmaz sat\u0131n alanlar\u0131n de\u011fil; sonraki maliklerin, cebri icra yoluyla ta\u015f\u0131nmaz edinenlerin, arsa sahibinden devir alan ki\u015filerin, bankalar\u0131n ve di\u011fer ipotek alacakl\u0131lar\u0131n\u0131n da TMK m.1023 kapsam\u0131nda korunup korunamayacaklar\u0131 somut olay\u0131n \u00f6zellikleri \u00e7er\u00e7evesinde de\u011ferlendirilmektedir. \u00c7al\u0131\u015fman\u0131n devam\u0131nda, \u0130\u00e7tihad\u0131 Birle\u015ftirme Karar\u0131 sonras\u0131nda Yarg\u0131tay taraf\u0131ndan verilen kararlar incelenerek, hangi \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin hangi \u015fartlar alt\u0131nda tapu siciline g\u00fcven ilkesinden yararlanabilece\u011fi ve yeni yakla\u015f\u0131m\u0131n uygulamadaki yans\u0131malar\u0131 ortaya konulacakt\u0131r.<\/p>\n<p><strong>\u0130\u00c7T\u0130HADI B\u0130RLE\u015eT\u0130RME KARARI SONRASINDA KORUMANIN KAPSAMI<\/strong><\/p>\n<p><strong>A. Y\u00fckleniciden Do\u011frudan Ta\u015f\u0131nmaz Sat\u0131n Alanlar<\/strong><\/p>\n<p>\u0130\u00e7tihad\u0131 Birle\u015ftirme B\u00fcy\u00fck Genel Kurulu&#8217;nun 16.05.2025 tarihli karar\u0131 sonras\u0131nda Yarg\u0131tay, y\u00fckleniciden ta\u015f\u0131nmaz sat\u0131n alan \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin hukuki durumunu tapu siciline g\u00fcven ilkesi ve iyiniyet karinesi \u00e7er\u00e7evesinde de\u011ferlendirmeye ba\u015flam\u0131\u015ft\u0131r. Bu yeni yakla\u015f\u0131m\u0131n temelinde, y\u00fckleniciden ta\u015f\u0131nmaz edinmi\u015f olman\u0131n tek ba\u015f\u0131na k\u00f6t\u00fcniyet g\u00f6stergesi say\u0131lamayaca\u011f\u0131 ve TMK m.1023 kapsam\u0131nda korunman\u0131n esas oldu\u011fu anlay\u0131\u015f\u0131 bulunmaktad\u0131r.<\/p>\n<p><strong><a href=\"https:\/\/www.hukukihaber.net\/yargitay-6-hukuk-dairesinin-2025190-e-20254167-k-sayili-karari\" rel=\"dofollow\">Yarg\u0131tay 6. Hukuk Dairesi&#8217;nin 04.12.2025 tarihli, E.2025\/190, K.2025\/4167 say\u0131l\u0131 karar\u0131<\/a>nda<\/strong>, y\u00fcklenicinin in\u015faat\u0131 tamamlamamas\u0131 nedeniyle s\u00f6zle\u015fmenin geriye etkili olarak feshi ve \u00fc\u00e7\u00fcnc\u00fc ki\u015filer ad\u0131na kay\u0131tl\u0131 tapular\u0131n iptali talep edilmi\u015f; ancak Daire, \u0130\u00e7tihad\u0131 Birle\u015ftirme Karar\u0131 sonras\u0131nda \u00fc\u00e7\u00fcnc\u00fc ki\u015filerin iyiniyetli olup olmad\u0131klar\u0131 ara\u015ft\u0131r\u0131lmaks\u0131z\u0131n h\u00fck\u00fcm kurulamayaca\u011f\u0131n\u0131 belirterek karar\u0131 bozmu\u015ftur. Kararda;<\/p>\n<p>&#8220;TMK&#8217;n\u0131n 3. maddesine g\u00f6re &#8230; \u00fc\u00e7\u00fcnc\u00fc ki\u015finin iyiniyetli oldu\u011fu Kanun gere\u011fince karine olarak kabul edilmelidir.&#8221;<\/p>\n<p>&#8220;Tapuya g\u00fcvenerek iktisap edilen ayni hakk\u0131n korunmas\u0131 gerekir.&#8221;<\/p>\n<p>tespitlerine yer verilmi\u015f, ayr\u0131ca \u00f6nceki uygulaman\u0131n temel dayanaklar\u0131ndan biri olan avans tapu anlay\u0131\u015f\u0131 a\u00e7\u0131k\u00e7a reddedilerek;<\/p>\n<p>&#8220;Arsa sahibinin y\u00fckleniciye devretti\u011fi tapunun avans tapu oldu\u011funun kabul\u00fc de m\u00fcmk\u00fcn de\u011fildir.&#8221;<\/p>\n<p>denilmi\u015ftir.<\/p>\n<p><strong><a href=\"https:\/\/www.hukukihaber.net\/yargitay-6-hukuk-dairesinin-20252930-e-20253634-k-sayili-karari\" rel=\"dofollow\">Yarg\u0131tay 6. Hukuk Dairesi&#8217;nin 28.10.2025 tarihli, E.2025\/2930, K.2025\/3634 say\u0131l\u0131 karar\u0131<\/a>nda<\/strong> ise \u0130\u00e7tihad\u0131 Birle\u015ftirme Kararlar\u0131n\u0131n g\u00f6r\u00fclmekte olan uyu\u015fmazl\u0131klar bak\u0131m\u0131ndan da ba\u011flay\u0131c\u0131 oldu\u011fu vurgulanm\u0131\u015f; daha \u00f6nce g\u00f6z ard\u0131 edilen iyiniyet incelemesinin bozma sebebi olu\u015fturdu\u011fu belirtilmi\u015ftir. Kararda;<\/p>\n<p>&#8220;\u0130\u00e7tihad\u0131 birle\u015ftirme kararlar\u0131 benzer hukuki konularda Yarg\u0131tay Genel Kurullar\u0131n\u0131, dairelerini ve adliye mahkemelerini ba\u011flar.&#8221;<\/p>\n<p>&#8220;TMK&#8217;n\u0131n 3. maddesine g\u00f6re &#8230; \u00fc\u00e7\u00fcnc\u00fc ki\u015finin iyiniyetli oldu\u011fu Kanun gere\u011fince karine olarak kabul edilmelidir.&#8221;<\/p>\n<p>ifadelerine yer verilmi\u015ftir.<\/p>\n<p>Yeni yakla\u015f\u0131m\u0131n bir di\u011fer sonucu, k\u00f6t\u00fcniyet iddias\u0131n\u0131n somut delillerle ispatlanmas\u0131n\u0131n zorunlu hale gelmesidir. <strong><a href=\"https:\/\/www.hukukihaber.net\/yargitay-6-hukuk-dairesinin-20243430-e-20252450-k-sayili-karari\" rel=\"dofollow\">Yarg\u0131tay 6. Hukuk Dairesi&#8217;nin 19.06.2025 tarihli, E.2024\/3430, K.2025\/2450 say\u0131l\u0131 karar\u0131<\/a>nda<\/strong>, \u00fc\u00e7\u00fcnc\u00fc ki\u015finin korunmas\u0131n\u0131n \u00f6n\u00fcne ge\u00e7ilebilmesi i\u00e7in, ta\u015f\u0131nmaz\u0131 edinirken arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesinin varl\u0131\u011f\u0131n\u0131 ve s\u00f6zle\u015fmenin geriye etkili fesih sebeplerini bildi\u011finin veya bilmesi gerekti\u011finin ispatlanmas\u0131 gerekti\u011fi belirtilmi\u015ftir. Daire ayr\u0131ca, arsa sahibine bu hususu ispatlayabilmesi i\u00e7in delillerini sunma imk\u00e2n\u0131 tan\u0131nmas\u0131n\u0131n zorunlu oldu\u011funu vurgulam\u0131\u015ft\u0131r.<\/p>\n<p>Tapu siciline g\u00fcven ilkesinin somut g\u00f6r\u00fcn\u00fcm\u00fc ise <strong><a href=\"https:\/\/www.hukukihaber.net\/yargitay-6-hukuk-dairesinin-20233082-e-20252258-k-sayili-karari\" rel=\"dofollow\">Yarg\u0131tay 6. Hukuk Dairesi&#8217;nin 28.05.2025 tarihli, E.2023\/3082, K.2025\/2258 say\u0131l\u0131 karar\u0131<\/a>nda<\/strong> ortaya konulmu\u015ftur. Kararda, tapu kayd\u0131nda arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesine ili\u015fkin herhangi bir \u015ferhin bulunmamas\u0131n\u0131n \u00fc\u00e7\u00fcnc\u00fc ki\u015finin iyiniyetinin en g\u00fc\u00e7l\u00fc g\u00f6stergelerinden biri oldu\u011fu kabul edilmi\u015f; tapuya g\u00fcvenerek ta\u015f\u0131nmaz edinen ki\u015finin, tapu siciline yans\u0131mayan hukuki uyu\u015fmazl\u0131klar\u0131n sonu\u00e7lar\u0131na katlanmaya zorlanamayaca\u011f\u0131 ifade edilmi\u015ftir.<\/p>\n<p>Bu kararlar birlikte de\u011ferlendirildi\u011finde; y\u00fckleniciden do\u011frudan ta\u015f\u0131nmaz sat\u0131n alan ki\u015filerin art\u0131k s\u0131rf bu nedenle k\u00f6t\u00fcniyetli kabul edilemeyece\u011fi, iyiniyetin as\u0131l oldu\u011fu, aksinin ise arsa sahibi taraf\u0131ndan somut delillerle ispatlanmas\u0131 gerekti\u011fi y\u00f6n\u00fcnde yeni ve istikrarl\u0131 bir Yarg\u0131tay uygulamas\u0131n\u0131n olu\u015ftu\u011fu g\u00f6r\u00fclmektedir.<\/p>\n<p><strong>B. Sonraki Malikler<\/strong><\/p>\n<div data-channel=\"121\" data-advert=\"temedya\" data-rotation=\"120\" class=\"mb-3 text-center\"><\/div>\n<div data-channel=\"121\" data-advert=\"temedya\" data-rotation=\"120\" class=\"mb-3 text-center\"><\/div>\n<p>\u0130\u00e7tihad\u0131 Birle\u015ftirme Karar\u0131 sonras\u0131nda Yarg\u0131tay, TMK m.1023 kapsam\u0131nda yap\u0131lacak iyiniyet incelemesinin yaln\u0131zca y\u00fckleniciden do\u011frudan ta\u015f\u0131nmaz sat\u0131n alan ki\u015filer bak\u0131m\u0131ndan de\u011fil, tapu devri zincirinde yer alan sonraki malikler bak\u0131m\u0131ndan da uygulanmas\u0131 gerekti\u011fini kabul etmi\u015ftir. B\u00f6ylece ta\u015f\u0131nmaz\u0131 y\u00fckleniciden de\u011fil, \u00f6nceki maliklerden devralan ki\u015filerin de s\u0131rf bu nedenle koruma d\u0131\u015f\u0131nda b\u0131rak\u0131lamayaca\u011f\u0131 ortaya konulmu\u015ftur.<\/p>\n<p>Bu yakla\u015f\u0131m\u0131n yans\u0131malar\u0131ndan biri olan <strong><a href=\"https:\/\/www.hukukihaber.net\/yargitay-6-hukuk-dairesinin-20234251-e-20252601-k-sayili-karari\" rel=\"dofollow\">Yarg\u0131tay 6. Hukuk Dairesi&#8217;nin 30.06.2025 tarihli, E.2023\/4251, K.2025\/2601 say\u0131l\u0131 karar\u0131<\/a>nda<\/strong>, ta\u015f\u0131nmaz\u0131 sonradan devralan maliklerin TMK m.1023 anlam\u0131nda korunmaya de\u011fer iyiniyete sahip olup olmad\u0131klar\u0131n\u0131n ayr\u0131ca ara\u015ft\u0131r\u0131lmas\u0131 gerekti\u011fi belirtilmi\u015ftir. Daire, arsa sahibinin tapu iptali ve tescil talebinin kabul edilebilmesi i\u00e7in, \u00fc\u00e7\u00fcnc\u00fc ki\u015finin ta\u015f\u0131nmaz\u0131 edindi\u011fi s\u0131rada s\u00f6zle\u015fmenin geriye etkili fesih ko\u015fullar\u0131n\u0131 bildi\u011finin veya bilmesi gerekti\u011finin somut delillerle ispatlanmas\u0131 gerekti\u011fini vurgulam\u0131\u015ft\u0131r.<\/p>\n<p>\u201c&#8230; h\u00fckm\u00fc temyiz eden tapu maliki olan daval\u0131lar\u0131n tapu sicilinde m\u00fclkiyeti devrald\u0131klar\u0131 anda, TMK&#8217;n\u0131n 1023. maddesi anlam\u0131nda korunmas\u0131 gereken iyiniyete sahip olmad\u0131klar\u0131n\u0131 &#8230; bildikleri veya bilmeleri gerekti\u011fi hususunda inceleme ve de\u011ferlendirme yap\u0131larak&#8230;\u201d \u201c&#8230; \u00fc\u00e7\u00fcnc\u00fc ki\u015finin ta\u015f\u0131nmaz\u0131 sat\u0131n ald\u0131\u011f\u0131 anda &#8230; s\u00f6zle\u015fmenin geriye etkili fesih ko\u015fullar\u0131n\u0131n bulundu\u011funu bildi\u011fini veya bilmesi gerekti\u011fini ispatlamas\u0131 halinde arsa sahibinin tapu iptali ve tescil talebi kabul edilebilir.\u201d<\/p>\n<p>Benzer \u015fekilde <strong><a href=\"https:\/\/www.hukukihaber.net\/yargitay-6-hukuk-dairesinin-2025319-e-20253046-k-sayili-karari\" rel=\"dofollow\">Yarg\u0131tay 6. Hukuk Dairesi&#8217;nin 23.09.2025 tarihli, E.2025\/319, K.2025\/3046 say\u0131l\u0131 karar\u0131<\/a>nda<\/strong>, ta\u015f\u0131nmaz\u0131n y\u00fckleniciden de\u011fil ba\u015fka bir malikten veya arsa sahibinden devral\u0131nm\u0131\u015f olmas\u0131n\u0131n TMK m.1023 korumas\u0131n\u0131 kendili\u011finden ortadan kald\u0131rmayaca\u011f\u0131 kabul edilmi\u015ftir. Kararda, sonraki maliklerin k\u00f6t\u00fcniyetli olduklar\u0131n\u0131n ispat\u0131 konusunda arsa sahiplerine delillerini sunma imk\u00e2n\u0131 tan\u0131nmas\u0131 gerekti\u011fi belirtilmi\u015f; t\u00fcm bilgi ve belgeler birlikte de\u011ferlendirilerek m\u00fclkiyet hakk\u0131n\u0131n korunup korunmayaca\u011f\u0131n\u0131n belirlenmesi gerekti\u011fi ifade edilmi\u015ftir.<\/p>\n<p>Bu kararlar birlikte de\u011ferlendirildi\u011finde; tapu siciline g\u00fcven ilkesinin yaln\u0131zca ilk al\u0131c\u0131y\u0131 de\u011fil, tapu devri zincirinde yer alan sonraki malikleri de korudu\u011fu, bu ki\u015filerin s\u0131rf y\u00fckleniciden do\u011frudan ta\u015f\u0131nmaz edinmemi\u015f olmalar\u0131 nedeniyle TMK m.1023 korumas\u0131ndan mahrum b\u0131rak\u0131lamayacaklar\u0131 anla\u015f\u0131lmaktad\u0131r. Yeni uygulamada belirleyici olan husus, edinimin hangi a\u015famada ger\u00e7ekle\u015fti\u011fi de\u011fil, ta\u015f\u0131nmaz\u0131 devralan ki\u015finin edinim an\u0131ndaki iyiniyetinin bulunup bulunmad\u0131\u011f\u0131d\u0131r.<\/p>\n<p><strong>C. Cebri \u0130cra Yoluyla Edinenler<\/strong><\/p>\n<p>Cebri icra yoluyla edinilen ta\u015f\u0131nmazlar\u0131n sonraki maliklerinin de TMK m.1023 kapsam\u0131nda korunabilece\u011fi kabul edilmi\u015ftir.<\/p>\n<p><a href=\"https:\/\/www.hukukihaber.net\/yargitay-6-hukuk-dairesinin-20243059-e-20252232-k-sayili-karari\" rel=\"dofollow\"><strong>Yarg\u0131tay 6. Hukuk Dairesi, 27.05.2025 Tarih, E.2024\/3059, K.2025\/2232<\/strong><\/a><\/p>\n<p>\u201cSomut olayda daval\u0131 K4, davaya konu 16 no&#8217;lu ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm\u00fc cebri icradan a\u00e7\u0131k art\u0131rma suretiyle sat\u0131n alan dava d\u0131\u015f\u0131 \u00fc\u00e7\u00fcnc\u00fc ki\u015fiden sat\u0131n ald\u0131\u011f\u0131n\u0131 beyan etmi\u015ftir.\u201d<\/p>\n<p>\u201cTapu devrinin cebri icraya dayanmas\u0131 halinde iyiniyet iddias\u0131n\u0131n da cebri icra ko\u015fullar\u0131na g\u00f6re de\u011ferlendirmesi gerekir.\u201d<\/p>\n<p>\u201cDavaya konu ta\u015f\u0131nmaz\u0131n cebri icra yoluyla sat\u0131n alan ki\u015fiden sat\u0131n al\u0131nmas\u0131 halinde TMK&#8217;n\u0131n 1023. maddesi gere\u011fi daval\u0131n\u0131n iyi niyetinin korunaca\u011f\u0131 g\u00f6zetilerek davan\u0131n reddine karar verilmesi gerekti\u011fi&#8230;\u201d<\/p>\n<p><strong>D. Arsa Sahibinden Devir Alanlar<\/strong><\/p>\n<p>Ta\u015f\u0131nmaz\u0131n do\u011frudan arsa sahibinden devral\u0131nd\u0131\u011f\u0131n\u0131n ileri s\u00fcr\u00fclmesi halinde de TMK m.1023 kapsam\u0131nda iyiniyet incelemesi yap\u0131lmas\u0131 gerekti\u011fi kabul edilmi\u015ftir. Bankalar ve \u0130potek Alacakl\u0131lar\u0131<\/strong><\/p>\n<p>\u0130\u00e7tihad\u0131 Birle\u015ftirme Karar\u0131 sonras\u0131nda Yarg\u0131tay, tapu siciline g\u00fcven ilkesinin yaln\u0131zca ta\u015f\u0131nmaz\u0131 sat\u0131n alan \u00fc\u00e7\u00fcnc\u00fc ki\u015fileri de\u011fil, tapu kayd\u0131na g\u00fcvenerek ta\u015f\u0131nmaz \u00fczerinde ipotek hakk\u0131 tesis eden bankalar\u0131 ve di\u011fer ipotek alacakl\u0131lar\u0131n\u0131 da korudu\u011funu kabul etmi\u015ftir. Buna g\u00f6re, arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesinin sonradan feshedilmi\u015f olmas\u0131 tek ba\u015f\u0131na ipote\u011fin kald\u0131r\u0131lmas\u0131 sonucunu do\u011furmamakta; ipotek alacakl\u0131s\u0131n\u0131n TMK m.1023 anlam\u0131nda korunmaya de\u011fer iyiniyete sahip olmad\u0131\u011f\u0131n\u0131n somut delillerle ortaya konulmas\u0131 gerekmektedir.<\/p>\n<p>Bu yakla\u015f\u0131m\u0131n a\u00e7\u0131k bi\u00e7imde benimsendi\u011fi <strong><a href=\"https:\/\/www.hukukihaber.net\/yargitay-6-hukuk-dairesinin-20243470-e-20253564-k-sayili-karari\" rel=\"dofollow\">Yarg\u0131tay 6. Hukuk Dairesi&#8217;nin 23.10.2025 tarihli, E.2024\/3470, K.2025\/3564 say\u0131l\u0131 karar\u0131<\/a>nda<\/strong>, tapu kayd\u0131nda s\u00f6zle\u015fmeye ili\u015fkin herhangi bir \u015ferhin bulunmamas\u0131 ve ipote\u011fin tapu kayd\u0131na g\u00fcvenilerek tesis edilmesi hususlar\u0131 \u00f6nemle vurgulanm\u0131\u015ft\u0131r. Kararda;<\/p>\n<p>&#8220;Tapuya g\u00fcvenerek y\u00fckleniciden arsa hissesi veya ba\u011f\u0131ms\u0131z b\u00f6l\u00fcm sat\u0131n alan yahut lehine ipotek tesis edilen iyiniyetli \u00fc\u00e7\u00fcnc\u00fc ki\u015finin TMK&#8217;n\u0131n 1023. maddesine istinaden iktisab\u0131n\u0131n korunmas\u0131 gerekir.&#8221;<\/p>\n<p>denilerek, ipotek alacakl\u0131lar\u0131n\u0131n da TMK m.1023 korumas\u0131ndan yararlanaca\u011f\u0131 a\u00e7\u0131k\u00e7a ifade edilmi\u015ftir.<\/p>\n<p>Benzer \u015fekilde <strong><a href=\"https:\/\/www.hukukihaber.net\/yargitay-6-hukuk-dairesinin-20241526-e-20252600-k-sayili-karari\" rel=\"dofollow\">Yarg\u0131tay 6. Hukuk Dairesi&#8217;nin 30.06.2025 tarihli, E.2024\/1526, K.2025\/2600 say\u0131l\u0131 karar\u0131<\/a>nda<\/strong>, aleni tapu siciline g\u00fcvenerek i\u015flem yapan ki\u015filerin iyiniyet karinesinden yararlanmas\u0131 gerekti\u011fi belirtilmi\u015f ve;<\/p>\n<p>&#8220;\u00dc\u00e7\u00fcnc\u00fc ki\u015fi, aleni tapu kayd\u0131n\u0131 inceleyerek &#8230; tapudan m\u00fclkiyet veya ipotek edinen ki\u015finin iyiniyet karinesinden \u00f6zellikle yararlanmal\u0131d\u0131r.&#8221;<\/p>\n<p>tespitine yer verilmi\u015ftir.<\/p>\n<p>Yarg\u0131tay&#8217;\u0131n bu konudaki yakla\u015f\u0131m\u0131 <strong><a href=\"https:\/\/www.hukukihaber.net\/yargitay-6-hukuk-dairesinin-20251090-e-20254230-k-sayili-karari\" rel=\"dofollow\">09.12.2025 tarihli, E.2025\/1090, K.2025\/4230 say\u0131l\u0131 karar\u0131<\/a>nda<\/strong> daha da netle\u015ftirilmi\u015ftir.
