Ba\u015fkalar\u0131n\u0131n s\u00f6zleri, mahkemenin tavr\u0131, dosyan\u0131n hangi h\u00e2kime d\u00fc\u015ft\u00fc\u011f\u00fc, m\u00fcvekkilin ki\u015filik yap\u0131s\u0131, kar\u015f\u0131 taraf\u0131n sald\u0131rgan \u00fcslubu, yarg\u0131laman\u0131n uzamas\u0131 veya kamusal atmosfer bizim irademize ba\u011fl\u0131 de\u011fildir. Oysa Stoac\u0131 dikkat tam bu ara b\u00f6lgeye y\u00f6nelir: \u201c<strong>Ben \u015fu anda neye tepki veriyorum? Olaya m\u0131, yoksa olay hakk\u0131nda zihnimde kurdu\u011fum c\u00fcmleye mi?\u201d<\/strong><\/p>\n<p>Bu ayr\u0131m avukatl\u0131kta ya\u015famsald\u0131r. \u00c7\u00fcnk\u00fc avukat, s\u00fcrekli olarak kendi denetim alan\u0131 ile denetimi d\u0131\u015f\u0131ndaki alan\u0131 kar\u0131\u015ft\u0131rma riskiyle kar\u015f\u0131 kar\u015f\u0131yad\u0131r. H\u00e2kimin k\u0131sa bir s\u00f6z\u00fc, avukat taraf\u0131ndan \u201cbeni dinlemiyorlar\u201d \u015feklinde yorumlanabilir. Savc\u0131n\u0131n sert m\u00fctalaas\u0131, \u201cdosya bitmi\u015f\u201d duygusuna yol a\u00e7abilir. M\u00fcvekkilin tela\u015fl\u0131 telefonlar\u0131, \u201cbana g\u00fcvenilmiyor\u201d yarg\u0131s\u0131na d\u00f6n\u00fc\u015febilir. Kar\u015f\u0131 taraf vekilinin sald\u0131rgan \u00fcslubu, \u201cki\u015fisel bir sayg\u0131s\u0131zl\u0131k\u201d olarak alg\u0131lanabilir.<\/p>\n<p>Oysa bu olaylar\u0131n her biri tek ba\u015f\u0131na hen\u00fcz bir mesleki kriz de\u011fildir. Krizi \u00e7o\u011fu zaman avukat\u0131n zihninde kurdu\u011fu ikinci c\u00fcmle yarat\u0131r.<\/p>\n<p>Bu ikinci c\u00fcmle \u015fudur:<\/p>\n<p>\u201cBana bunu yapamazlar.\u201d<\/p>\n<p>\u201cBu dosya art\u0131k kaybedildi.\u201d<\/p>\n<p>\u201cMahkeme zaten karar\u0131n\u0131 vermi\u015f.\u201d<\/p>\n<p>\u201cM\u00fcvekkil beni anlam\u0131yor.\u201d<\/p>\n<p>\u201cKar\u015f\u0131 taraf vekili beni k\u00fc\u00e7\u00fck d\u00fc\u015f\u00fcrmeye \u00e7al\u0131\u015f\u0131yor.\u201d<\/p>\n<p>Bu c\u00fcmleler, olay ile tepki aras\u0131na giren zihinsel yarg\u0131lard\u0131r. Stoac\u0131 bak\u0131\u015f, avukat\u0131 tam da bu ara b\u00f6lgede durmaya davet eder. Tepki vermeden \u00f6nce yarg\u0131y\u0131 incelemek gerekir. \u00c7\u00fcnk\u00fc yanl\u0131\u015f yarg\u0131 yanl\u0131\u015f tepkiyi, yanl\u0131\u015f tepki de yanl\u0131\u015f mesleki stratejiyi do\u011furur.<\/p>\n<p>Epiktetos\u2019un \u201c<strong>A\u011flamalar, s\u0131zlanmalar nedir? Yarg\u0131. Talihsizlik nedir? Yarg\u0131.<\/strong>\u201d s\u00f6z\u00fc, bu nedenle yaln\u0131zca bireysel ahlakla ilgili de\u011fildir. Avukatl\u0131k bak\u0131m\u0131ndan da derin bir mesleki uyar\u0131d\u0131r. Duru\u015fma salonunda bozulan \u015fey \u00e7o\u011fu zaman yaln\u0131zca usul de\u011fildir; avukat\u0131n kendi i\u00e7indeki yarg\u0131lama d\u00fczeni de bozulabilir. Olay hukuki zeminden \u00e7\u0131k\u0131p ki\u015fisel al\u0131nmaya d\u00f6n\u00fc\u015ft\u00fc\u011f\u00fcnde, tepki art\u0131k stratejik de\u011fil reaktif hale gelir.<\/p>\n<p>Stoac\u0131 avukat\u0131n ilk disiplini, i\u00e7inden ge\u00e7en bu ikinci c\u00fcmleyi yakalayabilmesidir.<\/p>\n<p><strong><a name=\"iii.-duru%C5%9Fma-salonunda-stoac%C4%B1-mesafe\">III. Duru\u015fma Salonunda Stoac\u0131 Mesafe<\/a><\/strong><\/p>\n<p>Duru\u015fma salonu, avukat\u0131n yaln\u0131zca hukuk bilgisinin de\u011fil, zihinsel dengesinin de s\u0131nand\u0131\u011f\u0131 yerdir. H\u00e2kimin sab\u0131rs\u0131zl\u0131\u011f\u0131, savc\u0131n\u0131n ilgisizli\u011fi, kar\u015f\u0131 taraf\u0131n provokasyonu, m\u00fcvekkilin kontrols\u00fcz m\u00fcdahaleleri ve salonun genel atmosferi avukat\u0131 aceleci, \u00f6fkeli veya da\u011f\u0131n\u0131k tepkiye zorlayabilir. Stoac\u0131 mesafe burada devreye girer. Bu mesafe, duygusuzluk de\u011fildir. Avukat\u0131n haks\u0131zl\u0131\u011fa kay\u0131ts\u0131z kalmas\u0131, m\u00fcvekkilinin ac\u0131s\u0131na yabanc\u0131la\u015fmas\u0131 veya yarg\u0131lamadaki ihlalleri kabullenmesi anlam\u0131na gelmez. Aksine mesleki m\u00fcdahalenin \u00f6fke yerine muhakemeye dayanmas\u0131d\u0131r.<\/p>\n<p>Duru\u015fmada \u00f6fke bazen hakl\u0131d\u0131r; fakat hakl\u0131 \u00f6fke her zaman do\u011fru tepki de\u011fildir. Avukat, \u00f6fkesini do\u011frudan d\u0131\u015fa vurmak yerine onu hukuki forma sokabildi\u011fi \u00f6l\u00e7\u00fcde etkili olur. \u201cBu yap\u0131lan haks\u0131zl\u0131k\u201d demek ba\u015fka, \u201cSay\u0131n Mahkeme, savunma hakk\u0131n\u0131n etkin kullan\u0131m\u0131 bak\u0131m\u0131ndan bu hususun tutana\u011fa ge\u00e7irilmesini talep ediyoruz\u201d demek ba\u015fkad\u0131r. Birincisi duygu bo\u015falmas\u0131d\u0131r; ikincisi mesleki m\u00fcdahaledir. Stoac\u0131 avukat, duygusunu ink\u00e2r etmez; fakat duygusunun esiri de olmaz. <strong>Duyguyu ham madde, muhakemeyi bi\u00e7im, hukuki \u00fcslubu ise mesleki ara\u00e7 olarak kullan\u0131r.<\/strong><\/p>\n<p>Marcus Aurelius\u2019un \u201c<strong>Fikirden kurtuldu\u011funda \u2018incindim\u2019 \u015fik\u00e2yeti de o an gidecek; \u2018incindim\u2019 \u015fik\u00e2yetinden kurtuldu\u011funda incinme de yok olacak\u201d<\/strong> d\u00fc\u015f\u00fcncesi burada \u00f6zellikle anlaml\u0131d\u0131r. Duru\u015fma salonunda avukat bazen ger\u00e7ekten engellenir, bazen ise yaln\u0131zca incinir. Bu iki h\u00e2l birbirine kar\u0131\u015ft\u0131r\u0131ld\u0131\u011f\u0131nda, mesleki diren\u00e7 ki\u015fisel k\u0131rg\u0131nl\u0131\u011fa d\u00f6n\u00fc\u015f\u00fcr. Avukat\u0131n g\u00f6revi, incinmeyi de\u011fil, ihlali tespit etmektir. \u00c7\u00fcnk\u00fc hukuk, incinmi\u015f egoyu de\u011fil, ihlal edilmi\u015f hakk\u0131 kayda ge\u00e7irir.<\/p>\n<p><strong><a name=\"X1a089aec51f3a4cca2994338a54f5c200cca5f7\">IV. Kar\u015f\u0131la\u015ft\u0131rma Y\u00f6ntemi: Benzer Olaylara Farkl\u0131 Tepkiler<\/a><\/strong><\/p>\n<p>Stoac\u0131 d\u00fc\u015f\u00fcncenin en g\u00fc\u00e7l\u00fc y\u00f6ntemlerinden biri kar\u015f\u0131la\u015ft\u0131rmad\u0131r. \u0130nsan farkl\u0131 durumlarda benzer \u015feylere nas\u0131l farkl\u0131 tepkiler verdi\u011fini fark etti\u011finde, tepkilerinin ka\u00e7\u0131n\u0131lmaz olmad\u0131\u011f\u0131n\u0131 g\u00f6rmeye ba\u015flar.<\/p>\n<p>Seneca\u2019n\u0131n verdi\u011fi \u00f6rnek \u00e7arp\u0131c\u0131d\u0131r: \u0130nsan evinde mermerin rengi, zeminin cilas\u0131 veya duvardaki k\u00fc\u00e7\u00fck bir kusur y\u00fcz\u00fcnden huzursuz olabilir; fakat d\u0131\u015far\u0131 \u00e7\u0131kt\u0131\u011f\u0131nda \u00e7amurlu yollara, y\u0131k\u0131lm\u0131\u015f duvarlara, kalabal\u0131\u011f\u0131n kirine ve d\u00fczensizli\u011fine s\u00fck\u00fbnetle bakabilir. Avukat da farkl\u0131 ba\u011flamlarda benzer davran\u0131\u015flara farkl\u0131 tepkiler verebilir. M\u00fcvekkilin tela\u015f\u0131n\u0131 \u201cinsani\u201d bulurken, stajyerin hatas\u0131n\u0131 \u201cdikkatsizlik\u201d diye sert kar\u015f\u0131layabilir. H\u00e2kimin s\u00f6z kesmesini \u201cusul ihlali\u201d olarak g\u00f6r\u00fcrken, kendi s\u00f6z kesmesini \u201cdosyay\u0131 toparlama \u00e7abas\u0131\u201d sayabilir. M\u00fcvekkilin Tepkisini Ta\u015f\u0131mak, Ona Teslim Olmamak<\/a><\/strong><\/p>\n<p>Avukat\u0131n kar\u015f\u0131la\u015ft\u0131\u011f\u0131 en \u00f6nemli zorluklardan biri, m\u00fcvekkilin psikolojik dalgalanmalar\u0131n\u0131 ta\u015f\u0131makt\u0131r. M\u00fcvekkil \u00e7o\u011fu zaman davas\u0131n\u0131 yaln\u0131zca hukuki bir uyu\u015fmazl\u0131k olarak ya\u015famaz; onu onur, g\u00fcvenlik, gelecek, aile, itibar ve varolu\u015f meselesi olarak hisseder. Bu nedenle m\u00fcvekkilin tepkisi yo\u011fun olabilir. \u00d6fkelenebilir, a\u011flayabilir, avukat\u0131 su\u00e7layabilir, acele karar isteyebilir, her geli\u015fmeden felaket sonucu \u00e7\u0131karabilir.<\/p>\n<p>Stoac\u0131 yakla\u015f\u0131m burada avukata iki \u015feyi ayn\u0131 anda \u00f6\u011fretir: M\u00fcvekkilin duygusunu anlamak ve o duyguya teslim olmamak. M\u00fcvekkilin \u00f6fkesi avukat\u0131n stratejisine, m\u00fcvekkilin korkusu avukat\u0131n karar\u0131na, m\u00fcvekkilin acelecili\u011fi avukat\u0131n dilek\u00e7esine h\u00e2kim olmaya ba\u015flar. Oysa avukat\u0131n i\u015flevi, m\u00fcvekkilin ham duygusunu hukuki dile, usule ve stratejiye \u00e7evirmektir. Bu nedenle avukat, m\u00fcvekkilin tepkisini bast\u0131ran de\u011fil; onu i\u015fleyen ki\u015fidir. M\u00fcvekkil \u201cmahkeme bizi mahvetti\u201d dedi\u011finde avukat\u0131n g\u00f6revi ayn\u0131 felaket diline kat\u0131lmak de\u011fildir. Avukat \u015f\u00f6yle d\u00fc\u015f\u00fcnebilmelidir: \u201cBu bir duygu c\u00fcmlesidir; hukuki kar\u015f\u0131l\u0131\u011f\u0131 nedir?\u201d<\/p>\n<p>E\u011fer ger\u00e7ekten usul ihlali varsa, bunun yolu itirazd\u0131r, tutanakt\u0131r, istinaft\u0131r, delil talebidir.
