Hukuk Dairesinin istinaf isteminin esastan reddine dair karar\u0131 ile birlikte &#8230; 4. Asliye Hukuk Mahkemesinin 2018\/235 E. &#8211; 2019\/382 K. say\u0131l\u0131 karar\u0131n Yarg\u0131tay&#8217;ca incelenmesi taraf vekillerince verilen dilek\u00e7eler ile istenilmi\u015f olmakla, dosyadaki belgeler okunup uyu\u015fmazl\u0131k anla\u015f\u0131ld\u0131ktan sonra gere\u011fi g\u00f6r\u00fc\u015f\u00fcl\u00fcp d\u00fc\u015f\u00fcn\u00fcld\u00fc:<br>K A R A R &#8211;<br>Dava, 4650 say\u0131l\u0131 Kanunla de\u011fi\u015fik 2942 say\u0131l\u0131 Kamula\u015ft\u0131rma Kanununun 10. maddesine dayanan kamula\u015ft\u0131rma konusu irtifak hakk\u0131 bedelinin tespiti ve bu hakk\u0131n davac\u0131 idare ad\u0131na tescili istemine ili\u015fkindir.\u0130lk derece mahkemesince davan\u0131n kabul\u00fc ile dava konusu ta\u015f\u0131nmaz\u0131n m\u00fclkiyet bedelinin verilmesine ili\u015fkin olarak verilen karara kar\u015f\u0131, taraf vekillerince yap\u0131lan istinaf ba\u015fvurusunun &#8230; B\u00f6lge Adliye Mahkemesi 5. Hukuk Dairesince esastan reddine karar verilmi\u015f olup; h\u00fck\u00fcm, taraf vekillerince temyiz edilmi\u015ftir.A\u015fa\u011f\u0131da a\u00e7\u0131klanan gerek\u00e7elerle &#8230; B\u00f6lge Adliye Mahkemesi 5. Hukuk Dairesinin istinaf ba\u015fvurusunun esastan ret karar\u0131 kald\u0131r\u0131ld\u0131ktan sonra &#8230; 4. Asliye Hukuk Mahkemesinin 2018\/235E- 2019\/382K. say\u0131l\u0131 karar\u0131n\u0131n incelenmesinde;Arsa niteli\u011findeki &#8230; \u0130li, &#8230; \u0130l\u00e7esi, &#8230; Mahallesi 7760 ada 27 parsel say\u0131l\u0131 ta\u015f\u0131nmaz\u0131n zeminine emsal kar\u015f\u0131la\u015ft\u0131rmas\u0131 yap\u0131larak de\u011fer bi\u00e7ilmesi y\u00f6ntem itibariyle do\u011frudur. Ancak;<br>1)Kamula\u015ft\u0131rma Kanunu&#8217;nun k\u0131ymet takdir esaslar\u0131n\u0131 belirten 11.maddesinin 1.f\u0131kras\u0131n\u0131n arsalara ili\u015fkin (g) bendi uyar\u0131nca, arsalar\u0131n bedelinin de\u011ferlendirme g\u00fcn\u00fcnden \u00f6nceki \u00f6zel amac\u0131 olmayan emsal sat\u0131\u015flara g\u00f6re hesaplanmas\u0131 ve dava konusu ta\u015f\u0131nmaz ile emsalin zaruret olmad\u0131k\u00e7a yak\u0131n b\u00f6lgelerde ve benzer y\u00fcz\u00f6l\u00e7\u00fcml\u00fc olmas\u0131 ve de\u011ferlendirme tarihine yak\u0131n sat\u0131\u015flar\u0131n emsal al\u0131nmas\u0131 gerekir.<br>H\u00fckme esas al\u0131nan bilirki\u015fi raporunda bu y\u00f6nteme uyulmadan dava konusu ta\u015f\u0131nmaza g\u00f6re y\u00fcz\u00f6l\u00e7\u00fcm\u00fc b\u00fcy\u00fck bir ta\u015f\u0131nmaz\u0131n emsal al\u0131nmas\u0131 do\u011fru olmad\u0131\u011f\u0131 gibi, emsal al\u0131nan &#8230; mahallesi 4490 ada 13 parsel say\u0131l\u0131 ta\u015f\u0131nmaz\u0131n tapu ve sat\u0131\u015f akit tablosunun incelenmesinden, serbest sat\u0131\u015f olmad\u0131\u011f\u0131, belediyenin bir anonim \u015firkete sat\u0131\u015f\u0131 olup, bu sat\u0131\u015f\u0131n taraflar\u0131 ve ta\u015f\u0131nmazlar\u0131n nitelikleri dikkate al\u0131nd\u0131\u011f\u0131nda ticari ama\u00e7l\u0131 bir sat\u0131\u015f oldu\u011fu ve ta\u015f\u0131nmaz\u0131n ger\u00e7ek de\u011ferini yans\u0131tmad\u0131\u011f\u0131 izlenimini uyand\u0131rd\u0131\u011f\u0131 anla\u015f\u0131ld\u0131\u011f\u0131ndan bu rapora g\u00f6re h\u00fck\u00fcm kurulmas\u0131 m\u00fcmk\u00fcn de\u011fildir.Bu durumda; taraflara, dava konusu ta\u015f\u0131nmaza yak\u0131n b\u00f6lgelerden ve yak\u0131n zaman i\u00e7inde sat\u0131\u015f\u0131 yap\u0131lan benzer y\u00fcz\u00f6l\u00e7\u00fcml\u00fc sat\u0131\u015flar\u0131 bildirmeleri i\u00e7in imkan tan\u0131nmas\u0131, l\u00fczumu halinde re&#8217;sen emsal celbi yoluna gidilmesi, ta\u015f\u0131nmaz\u0131n, de\u011ferlendirme tarihi itibariyle, emsal al\u0131nacak ta\u015f\u0131nmaz\u0131n ise sat\u0131\u015f tarihi itibariyle imar ya da kadastro parselleri olup olmad\u0131\u011f\u0131 ilgili Belediye Ba\u015fkanl\u0131\u011f\u0131 ve Tapu M\u00fcd\u00fcrl\u00fc\u011f\u00fcnden sorulmas\u0131, ayr\u0131ca dava konusu ta\u015f\u0131nmaz\u0131n; imar plan\u0131ndaki konumu, emsallere ve de\u011ferini etkileyen merkezi yerlere olan uzakl\u0131\u011f\u0131n\u0131 da g\u00f6sterir krokisi ve dava konusu ta\u015f\u0131nmaz ile emsal ta\u015f\u0131nmazlar\u0131n resen belirlenen vergi de\u011ferleri ve emsal ta\u015f\u0131nmazlar\u0131n sat\u0131\u015f akit tablosu getirtilerek, dava konusu ta\u015f\u0131nmaz\u0131n de\u011ferlendirmeye esas al\u0131nacak emsallere g\u00f6re ayr\u0131 ayr\u0131 \u00fcst\u00fcn ve eksik y\u00f6nleri ve oranlar\u0131 a\u00e7\u0131klanmak suretiyle yap\u0131lacak kar\u015f\u0131la\u015ft\u0131rma sonucu de\u011ferinin belirlenmesi bak\u0131m\u0131ndan, yeniden olu\u015fturulacak bilirki\u015fi kurulu marifetiyle mahallinde ke\u015fif yap\u0131larak al\u0131nacak rapor sonucuna g\u00f6re h\u00fck\u00fcm kurulmas\u0131 gerekti\u011finin d\u00fc\u015f\u00fcn\u00fclmemesi,<br>Do\u011fru olmad\u0131\u011f\u0131 gibi,<br>2)Avrupa \u0130nsan Haklar\u0131 Mahkemesinin 12055\/17 numaral\u0131 ba\u015fvuru sonucu verilen&nbsp;<strong>23.10.2018&nbsp;<\/strong>tarihli karar\u0131 ve Anayasa Mahkemesinin 2016\/9364 ba\u015fvuru numaral\u0131,&nbsp;<strong>01.06.2019&nbsp;<\/strong>g\u00fcn 30791 say\u0131l\u0131 Resmi Gazete&#8217;de yay\u0131mlanan karar\u0131 da g\u00f6z \u00f6n\u00fcne al\u0131narak davac\u0131 idare lehine vekalet \u00fccretine h\u00fckmedilmemesi gerekti\u011finden,<br>3)Anayasa Mahkemesinin&nbsp;<strong>27\/11\/2020&nbsp;<\/strong>g\u00fcn 31317 say\u0131l\u0131 Resmi Gazetede yay\u0131mlanan&nbsp;<strong>16\/07\/2020&nbsp;<\/strong>tarih 2018\/104 Esas 2020\/39 Karar say\u0131l\u0131 karar\u0131 ile 7139 say\u0131l\u0131 Kanunla De\u011fi\u015fik Kamula\u015ft\u0131rma Kanunun 10\/8. F\u0131kras\u0131n\u0131n d\u00f6rd\u00fcnc\u00fc c\u00fcmlesi; &#8216;idarenin k\u0131ymet takdir komisyonunca tespit edilen bedelden az olmas\u0131 durumunda h\u00e2kim taraf\u0131ndan tespit edilen bedel, fazla olmas\u0131 durumunda idarenin k\u0131ymet takdir komisyonunca tespit etti\u011fi bedel, pe\u015fin ve nakit olarak hak sahibi ad\u0131na, kalan\u0131 ise bedele ili\u015fkin karar\u0131n kesinle\u015fmesine kadar \u00fc\u00e7er ayl\u0131k vadeli hesapta nemaland\u0131r\u0131lmak ve kesinle\u015fen karara g\u00f6re hak sahibine verilmek \u00fczere&#8217; b\u00f6l\u00fcm\u00fc ile yedinci c\u00fcmlesinde yer alan &#8216;idarenin k\u0131ymet takdir komisyonunca tespit etti\u011fi bedelden fazla olmas\u0131 halinde fazla olan tutar\u0131n bloke edildi\u011fine&#8217; ibaresinin Anayasa&#8217;ya ayk\u0131r\u0131 oldu\u011fu ve iptal edildi\u011fi nazara al\u0131narak h\u00fck\u00fcm kurulmas\u0131 gerekti\u011finden,H\u00fckm\u00fcn yukar\u0131da a\u00e7\u0131klanan gerek\u00e7elerle taraf vekillerinin temyiz isteminin kabul\u00fc ile&nbsp;<strong>BOZULMASINA<\/strong>,&nbsp;<strong>HMK<\/strong>&#8216;nun 373\/1. maddesi uyar\u0131nca karar\u0131n bir \u00f6rne\u011finin &#8230; B\u00f6lge Adliye Mahkemesi 5.
