Asliye Hukuk Mahkemesi; uyu\u015fmazl\u0131\u011f\u0131n 4077 Say\u0131l\u0131 Kanun kapsam\u0131na girdi\u011fi ve t\u00fcketici mahkemesinin g\u00f6revli oldu\u011fu gerek\u00e7esiyle g\u00f6revsizlik karar\u0131 verilmi\u015ftir.<\/p>\n\n\n\n<p>6502 Say\u0131l\u0131 Kanun\u2019un 3. maddesi gerek\u00e7esinde eser s\u00f6zle\u015fmelerinin kanun kapsam\u0131na al\u0131nmas\u0131na dair herhangi bir a\u00e7\u0131klama getirilmemi\u015ftir. Ancak, kanunun sistemati\u011fi nazara al\u0131nd\u0131\u011f\u0131nda kanunda zikredilen eser s\u00f6zle\u015fmelerinden kast\u0131n; ticari ve mesleki olmayan ama\u00e7larla, salt ki\u015fisel ihtiya\u00e7lar\u0131 i\u00e7in kullanma ve t\u00fcketme amac\u0131yla ger\u00e7ek ve t\u00fczel ki\u015fi ile t\u00fcketici aras\u0131nda yap\u0131lan eser s\u00f6zle\u015fmeleri oldu\u011fu anla\u015f\u0131lmaktad\u0131r. Arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmeleri 818 Say\u0131l\u0131 BK\u2019n\u0131n 155 vd. maddelerinde d\u00fczenlenen eser s\u00f6zle\u015fmelerinin kendine \u00f6zg\u00fc bir t\u00fcr\u00fcd\u00fcr. Bu s\u00f6zle\u015fmelerin bir taraf\u0131 arsa sahibi di\u011fer taraf\u0131 y\u00fcklenicidir. Bu t\u00fcr s\u00f6zle\u015fmelerde arsa sahibinin T\u00fcketici Kanununda 3\/k maddesindeki t\u00fcketici tan\u0131m\u0131na uymad\u0131\u011f\u0131 anla\u015f\u0131lmaktad\u0131r. Arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmelerinde arsa sahibi a\u00e7\u0131s\u0131ndan g\u00fcd\u00fclen ama\u00e7 kullanmak i\u00e7in konut edinmek de\u011fil arsas\u0131n\u0131 de\u011ferlendirmektir. Bu nedenle, arsa sahibinin arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmesi imzalarken g\u00fctt\u00fc\u011f\u00fc saikin 6502 Say\u0131l\u0131 Kanunda tan\u0131mlanan t\u00fcketicinin saikinden farkl\u0131 oldu\u011fu g\u00f6zden ka\u00e7\u0131r\u0131lmamal\u0131d\u0131r. Arsa pay\u0131 kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmelerine konu i\u015fin \u00fcst d\u00fczey teknolojiyi gerektirmesi, s\u00f6zle\u015fme kapsam\u0131nda ta\u015f\u0131nmaz sat\u0131\u015f vaadi ve in\u015faat s\u00f6zle\u015fmelerinin de bulundu\u011fu nazara al\u0131nd\u0131\u011f\u0131nda 6502 Say\u0131l\u0131 Kanunda kanun koyucunun salt kullanma ve t\u00fcketme amac\u0131na y\u00f6nelik mutfak, dolap yapt\u0131rmak ara\u00e7 tamiri yapmak gibi dar kapsaml\u0131 eser s\u00f6zle\u015fmelerini kastetti\u011fi, arsa kar\u015f\u0131l\u0131\u011f\u0131 in\u015faat s\u00f6zle\u015fmelerinin ise bu kapsamda olmad\u0131\u011f\u0131n\u0131n kabul\u00fc gerekir. Bu durumda eldeki davada uyu\u015fmazl\u0131k 6502 Say\u0131l\u0131 Kanun kapsam\u0131nda kalmad\u0131\u011f\u0131ndan, davan\u0131n HMK\u2019n\u0131n 2. maddesi uyar\u0131nca genel h\u00fck\u00fcmlere g\u00f6re 1. Asliye Hukuk Mahkemesinde g\u00f6r\u00fcl\u00fcp sonu\u00e7land\u0131r\u0131lmas\u0131 gerekmektedir (Yarg\u0131tay 20.
