Dava konusu olayda davac\u0131n\u0131n 03.07.2000 tarihinde tespit edilen meslek hastal\u0131\u011f\u0131 nedeniyle %83,50 oran\u0131nda s\u00fcrekli i\u015f g\u00f6remezli\u011fe u\u011frad\u0131\u011f\u0131 ve 04.08.2000 tarihinden ba\u015flamak \u00fczere 21.10.2002 onay tarihli gelir ba\u011fland\u0131\u011f\u0131 dosyadaki bilgi ve belgelerden anla\u015f\u0131lmaktad\u0131r. Davac\u0131ya s\u00fcrekli i\u015f g\u00f6remezlik tayinine esas al\u0131nan meslek hastal\u0131\u011f\u0131 bak\u0131m\u0131ndan de\u011fi\u015fen ve geli\u015fen bir durumun s\u00f6z konusu olmad\u0131\u011f\u0131, Meslek hastal\u0131klar\u0131nda zaman a\u015f\u0131m\u0131n\u0131n meslek hastal\u0131\u011f\u0131n\u0131n tespit tarihinden ba\u015flayaca\u011f\u0131 a\u00e7\u0131kt\u0131r. Bu duruma g\u00f6re meslek hastal\u0131\u011f\u0131n\u0131n tespit tarihi dikkate al\u0131nd\u0131\u011f\u0131nda 14.11.2015 ek dava tarihinde yasan\u0131n \u00f6ng\u00f6rd\u00fc\u011f\u00fc 10 y\u0131ll\u0131k s\u00fcrenin ge\u00e7ti\u011fi a\u00e7\u0131kt\u0131r. Hal b\u00f6yle olunca, s\u00fcresi i\u00e7erisinde daval\u0131 taraf\u0131ndan ileri s\u00fcr\u00fclen zamana\u015f\u0131m\u0131 def\u2019inin kabul edilerek ek dava konusu maddi tazminat talebinin reddine karar verilmesi gerekirken, ek dava konusu talebi de kapsar bi\u00e7imde maddi tazminat isteminin kabul\u00fcne karar verilmesi hatal\u0131 olmu\u015ftur. 2000 y\u0131l\u0131nda tespit edilen meslek hastal\u0131\u011f\u0131 nedeniyle s\u00fcrekli i\u015f g\u00f6remezlik oran\u0131na ili\u015fkin olarak 2014 y\u0131l\u0131nda \u2026. taraf\u0131ndan yap\u0131lan de\u011ferlendirmenin zaman a\u015f\u0131m\u0131n\u0131n ba\u015flang\u0131c\u0131n\u0131n belirlenmesi anlam\u0131nda davac\u0131ya bir hak kazand\u0131rmayaca\u011f\u0131 ortadad\u0131r. Davac\u0131 as\u0131l ve birle\u015fen davalarda h\u00fck\u00fcm alt\u0131na al\u0131nan tazminatlara maluliyetin tespit tarihinden itibaren yasal faiz y\u00fcr\u00fct\u00fclmesi a\u00e7\u0131k\u00e7a istenmi\u015ftir. \u00d6te yandan meslek hastal\u0131\u011f\u0131 sonucu s\u00fcrekli i\u015f g\u00f6remezlik nedeniyle a\u00e7\u0131lan davalarda faizin zarar\u0131n meydana geldi\u011fi meslek hastal\u0131\u011f\u0131n\u0131n tespit tarihinden itibaren y\u00fcr\u00fct\u00fclece\u011fi, meslek hastal\u0131\u011f\u0131n\u0131n tespiti ile birlikte zarar veren bak\u0131m\u0131ndan temerr\u00fcte d\u00fc\u015f\u00fcld\u00fc\u011f\u00fcn\u00fcn kabul\u00fcn\u00fcn gerekti\u011fi dairemizin ve giderek Yarg\u0131tay\u2019\u0131n yerle\u015fmi\u015f uygulamalar\u0131ndand\u0131r. Hal b\u00f6yle olunca da davan\u0131n niteli\u011fine g\u00f6re meslek hastal\u0131\u011f\u0131n\u0131n tespit edildi\u011fi 03.07.2000 tarihinden itibaren faize karar verilmek gerekirken, \u2026 rapor tarihinden itibaren faize karar verilmesi usul ve yasaya ayk\u0131r\u0131 olup bozma nedenidir.
