{"id":10745,"date":"2022-06-16T08:47:11","date_gmt":"2022-06-16T08:47:11","guid":{"rendered":"https:\/\/www.avrasyahukuk.com.tr\/?p=10745"},"modified":"2022-06-16T08:47:13","modified_gmt":"2022-06-16T08:47:13","slug":"yargitay-hukuk-genel-kurulu-karar-2018-1185","status":"publish","type":"post","link":"https:\/\/www.avrasyahukuk.com.tr\/index.php\/2022\/06\/16\/yargitay-hukuk-genel-kurulu-karar-2018-1185\/","title":{"rendered":"Yarg\u0131tay Hukuk Genel Kurulu &#8211; Karar : 2018\/1185"},"content":{"rendered":"\n<h3 id=\"meslek-hastal\u0131\u011f\u0131-nedir-\u015fartlar\u0131-nelerdir\">Meslek Hastal\u0131\u011f\u0131 Nedir? \u015eartlar\u0131 Nelerdir?<\/h3>\n\n\n\n<p>Mevzuat\u0131m\u0131zda ise meslek hastal\u0131\u011f\u0131n\u0131n tan\u0131m\u0131 01.10.2008 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren 5510 say\u0131l\u0131 Sosyal Sigortalar ve Genel Sa\u011fl\u0131k Sigortas\u0131 Kanunu\u2019nun \u201cMeslek hastal\u0131\u011f\u0131n\u0131n tan\u0131m\u0131, bildirilmesi ve soru\u015fturulmas\u0131\u201d ba\u015fl\u0131kl\u0131 14\u2019\u00fcnc\u00fc maddesinin ilk f\u0131kras\u0131nda yap\u0131lm\u0131\u015ft\u0131r. \u0130lgili f\u0131kraya g\u00f6re meslek hastal\u0131\u011f\u0131, sigortal\u0131n\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 veya yapt\u0131\u011f\u0131 i\u015fin niteli\u011finden dolay\u0131 tekrarlanan bir sebeple veya i\u015fin y\u00fcr\u00fct\u00fcm \u015fartlar\u0131 y\u00fcz\u00fcnden u\u011frad\u0131\u011f\u0131 ge\u00e7ici veya s\u00fcrekli hastal\u0131k, bedensel veya ruhsal engellilik h\u00e2lleridir. Ayr\u0131ca 01.01.2013 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren 6331 say\u0131l\u0131 \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Kanunu\u2019nun \u201cTan\u0131mlar\u201d ba\u015fl\u0131kl\u0131 3\u2019\u00fcnc\u00fc maddesinin birinci f\u0131kras\u0131n\u0131n \u201cl\u201d bendinde de meslek hastal\u0131\u011f\u0131, mesleki risklere maruziyet sonucu ortaya \u00e7\u0131kan hastal\u0131k olarak tan\u0131mlanm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Hemen belirtilmelidir ki bir sosyal risk olarak meslek hastal\u0131\u011f\u0131n\u0131n di\u011fer hastal\u0131klardan ay\u0131rt edilebilmesi ve meslek hastal\u0131\u011f\u0131n\u0131n varl\u0131\u011f\u0131ndan bahsedilebilmesi i\u00e7in bir tak\u0131m \u015fartlar\u0131n bir arada bulunmas\u0131 gerekmektedir. Ger\u00e7ekten de hastal\u0131\u011f\u0131n ya da bedensel veya ruhsal engellilik h\u00e2linin meslek hastal\u0131\u011f\u0131 olarak nitelendirilebilmesi i\u00e7in ilk \u015fart, ki\u015finin sigortal\u0131 olmas\u0131d\u0131r. Bunun yan\u0131nda hastal\u0131k, bedensel veya ruhsal engellilik h\u00e2linin y\u00fcr\u00fct\u00fclen i\u015fin sonucu olarak ortaya \u00e7\u0131kmal\u0131 di\u011fer bir ifadeyle uygun illiyet ba\u011f\u0131 bulunmal\u0131d\u0131r. Ayr\u0131ca belirli bir zaman dilimi i\u00e7erisinde olu\u015fmal\u0131d\u0131r. Yine meslek hastal\u0131\u011f\u0131 y\u00f6netmelikte yer almal\u0131, belirtilen s\u00fcre i\u00e7erisinde meydana gelmeli ve Kurum sa\u011fl\u0131k raporu ile saptanmal\u0131d\u0131r. Son olarak sigortal\u0131n\u0131n beden veya ruh\u00e7a bir zarara u\u011framas\u0131 \u015fart\u0131n\u0131n da ger\u00e7ekle\u015fmesi gerekmektedir.<\/p>\n\n\n\n<p>Yukar\u0131da da belirtildi\u011fi gibi meslek hastal\u0131\u011f\u0131 sigortas\u0131ndan yararlanabilmenin ilk \u015fart\u0131 hastal\u0131k, bedensel veya ruhsal engellilik halinin ortaya \u00e7\u0131kt\u0131\u011f\u0131 ki\u015finin 5510 say\u0131l\u0131 Kanun ile d\u00fczenlenen \u0130\u015f Kazas\u0131 ve Meslek Hastal\u0131\u011f\u0131 Sigortas\u0131 kapsam\u0131nda sigortal\u0131 olmas\u0131d\u0131r.<\/p>\n\n\n\n<p>Bu ki\u015filer 5510 say\u0131l\u0131 Kanunun 4\u2019\u00fcnc\u00fc maddesinin birinci f\u0131kras\u0131n\u0131n \u201ca\u201d ve \u201cb\u201d bentlerine tabi sigortal\u0131lar ile 5\u2019inci maddesinin \u201ca\u201d, \u201cb\u201d, \u201cc\u201d, \u201ce\u201d ve \u201cg\u201d bentleri ve Ek 5\/4\u2019\u00fcnc\u00fc maddesinde ge\u00e7en ve haklar\u0131nda i\u015f kazas\u0131 ve meslek hastal\u0131\u011f\u0131 sigortas\u0131n\u0131n uygulanaca\u011f\u0131 belirtilen sigortal\u0131lard\u0131r.<\/p>\n\n\n\n<p>Meslek hastal\u0131\u011f\u0131n\u0131n varl\u0131\u011f\u0131 i\u00e7in aranacak di\u011fer bir \u015fart, hastal\u0131\u011f\u0131n ya da bedensel veya ruhsal engellilik h\u00e2linin y\u00fcr\u00fct\u00fclen i\u015fin sonucu olarak ortaya \u00e7\u0131kmas\u0131, di\u011fer bir ifadeyle uygun illiyet ba\u011f\u0131n\u0131n bulunmas\u0131d\u0131r. E\u011fer i\u015f\u00e7inin \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015fte \u00e7al\u0131\u015fmamas\u0131 h\u00e2linde hastal\u0131\u011fa yakalanmayaca\u011f\u0131 s\u00f6ylenebiliyorsa bu durumda meslek hastal\u0131\u011f\u0131 ile y\u00fcr\u00fct\u00fclen i\u015f aras\u0131nda uygun illiyet ba\u011f\u0131n\u0131n bulundu\u011fu kabul edilmelidir (M. \u00c7enberci, Sosyal Sigortalar Kanunu \u015eerhi, Ankara 1985, s. 125). Ba\u015fka bir s\u00f6yleyi\u015fle hizmet akdine g\u00f6re i\u015fverenin i\u015fyerinde \u00e7al\u0131\u015fan i\u015f\u00e7i, hastal\u0131\u011fa, g\u00f6rd\u00fc\u011f\u00fc i\u015fin \u00f6zellik ve niteli\u011fi veya i\u015fin y\u00fcr\u00fct\u00fcm \u015fartlar\u0131 dolay\u0131s\u0131yla tutulmu\u015f ise uygun illiyet ba\u011f\u0131 mevcuttur (F. Eren, Bor\u00e7lar Hukuku ve \u0130\u015f Hukuku A\u00e7\u0131s\u0131ndan \u0130\u015fverenin \u0130\u015fkazas\u0131 ve Meslek Hastal\u0131\u011f\u0131ndan Do\u011fan Sorumlulu\u011fu, Ankara 1974, s. 28).<\/p>\n\n\n\n<p>Aranacak bir ba\u015fka \u015fart ise meslek hastal\u0131\u011f\u0131n\u0131n belirli bir zaman dilimi i\u00e7erisinde olu\u015fmas\u0131d\u0131r. 5510 say\u0131l\u0131 Kanun\u2019un meslek hastal\u0131\u011f\u0131 tan\u0131m\u0131nda da belirtildi\u011fi \u00fczere meslek hastal\u0131\u011f\u0131 tekrarlanan bir sebeple ortaya \u00e7\u0131kmal\u0131d\u0131r. Ger\u00e7ekten de meslek hastal\u0131\u011f\u0131 i\u015fin nitelik ve y\u00fcr\u00fct\u00fcm \u015fartlar\u0131 sonucu ya da i\u015fyerinin durumu dolay\u0131s\u0131yla yava\u015f yava\u015f ortaya \u00e7\u0131kan bir sa\u011fl\u0131k sorunudur (C. Tuncay\/\u00d6. Ekmek\u00e7i s. 401). Esasen meslek hastal\u0131\u011f\u0131n\u0131 i\u015f kazas\u0131ndan ay\u0131ran en b\u00fcy\u00fck \u00f6zellik, i\u015f kazas\u0131nda kazay\u0131 meydana getiren harici sebebin bir defada cereyan\u0131 iken, meslek hastal\u0131\u011f\u0131nda bu sebebin devaml\u0131 olarak tekrarlanmas\u0131d\u0131r (F. Eren, s. 26). Bu nedenle meslek hastal\u0131\u011f\u0131 i\u015f kazas\u0131 gibi aniden ve \u00e7ok k\u0131sa bir zaman aral\u0131\u011f\u0131nda meydana gelmemekte zamana yay\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p>Yine meslek hastal\u0131\u011f\u0131 i\u00e7in aranacak \u015fartlardan baz\u0131lar\u0131 meslek hastal\u0131\u011f\u0131n\u0131n y\u00f6netmelikte yer almas\u0131, belirtilen s\u00fcre i\u00e7erisinde meydana gelmesi ve Kurum sa\u011fl\u0131k raporu ile saptanmas\u0131d\u0131r.<\/p>\n\n\n\n<p>5510 say\u0131l\u0131 Kanun\u2019un 14\u2019\u00fcnc\u00fc maddesinin son f\u0131kras\u0131nda;<\/p>\n\n\n\n<p>\u201cHangi h\u00e2llerin meslek hastal\u0131\u011f\u0131 say\u0131laca\u011f\u0131, i\u015f kazas\u0131 ve meslek hastal\u0131\u011f\u0131 bildirgesinin \u015fekli ve i\u00e7eri\u011fi, verilme us\u00fbl\u00fc ile bu maddenin uygulanmas\u0131na ili\u015fkin di\u011fer us\u00fbl ve esaslar, Kurum taraf\u0131ndan \u00e7\u0131kar\u0131lacak y\u00f6netmelikte d\u00fczenlenir. Y\u00f6netmelikte belirlenmi\u015f hastal\u0131klar d\u0131\u015f\u0131nda herhangi bir hastal\u0131\u011f\u0131n meslek hastal\u0131\u011f\u0131 say\u0131l\u0131p say\u0131lmamas\u0131 hususunda \u00e7\u0131kabilecek uyu\u015fmazl\u0131klar, Sosyal Sigorta Y\u00fcksek Sa\u011fl\u0131k Kurulunca karara ba\u011flan\u0131r.\u201d d\u00fczenlemesi getirilmi\u015ftir.<\/p>\n\n\n\n<p>Kanunda bahsi ge\u00e7en y\u00f6netmelik ise \u00c7al\u0131\u015fma G\u00fcc\u00fc ve Meslekte Kazanma G\u00fcc\u00fc Kayb\u0131 Oran\u0131 Tespit \u0130\u015flemleri Y\u00f6netmeli\u011fi\u2019dir. \u0130lgili Y\u00f6netmelik ekinde meslek hastal\u0131klar\u0131 listesi yer almakta olup bir hastal\u0131\u011f\u0131n meslek hastal\u0131\u011f\u0131 olarak kabul\u00fc i\u00e7in bu listede yer al\u0131yor olmas\u0131 gerekmektedir. Listede yer almayan ancak meslek hastal\u0131\u011f\u0131 oldu\u011fu d\u00fc\u015f\u00fcn\u00fclen durumlarda ise ortaya \u00e7\u0131kan uyu\u015fmazl\u0131k Y\u00fcksek Sa\u011fl\u0131k Kurulunun karar\u0131 ile giderilecektir.<\/p>\n\n\n\n<p>Kald\u0131 ki hastal\u0131\u011f\u0131n meslek hastal\u0131\u011f\u0131 olarak kabul\u00fc i\u00e7in sadece listede yer almas\u0131 yeterli olmay\u0131p ayn\u0131 zamanda hastal\u0131\u011f\u0131n i\u015f\u00e7inin hastal\u0131\u011fa neden olan i\u015fte \u00e7al\u0131\u015fmaya ba\u015flamas\u0131ndan itibaren belirli bir zaman ge\u00e7mesinden sonra ortaya \u00e7\u0131kmas\u0131 da gereklidir. \u00d6rne\u011fin \u00c7al\u0131\u015fma G\u00fcc\u00fc ve Meslekte Kazanma G\u00fcc\u00fc Kayb\u0131 Oran\u0131 Tespit \u0130\u015flemleri Y\u00f6netmeli\u011fi\u2019nin 20\u2019inci maddesinin birinci f\u0131kras\u0131na g\u00f6re \u201cPn\u00f6mokonyozun meslek hastal\u0131\u011f\u0131 say\u0131labilmesi i\u00e7in, sigortal\u0131n\u0131n, havas\u0131nda pn\u00f6mokonyoz yapacak yo\u011funluk ve nitelikte toz bulunan yeralt\u0131 veya yer\u00fcst\u00fc i\u015fyerlerinde toplam olarak en az \u00fc\u00e7 y\u0131l \u00e7al\u0131\u015fm\u0131\u015f olmas\u0131 \u015fartt\u0131r\u201d (C. Tuncay\/\u00d6. Ekmek\u00e7i s. 401).<\/p>\n\n\n\n<p>\u00d6te yandan 5510 say\u0131l\u0131 Kanunun 14\u2019\u00fcnc\u00fc maddesi ve Sosyal Sigortalar \u0130\u015flemleri Y\u00f6netmeli\u011fi 36\/1\u2019inci maddesinde belirtildi\u011fi \u00fczere sigortal\u0131n\u0131n meslek hastal\u0131\u011f\u0131na tutuldu\u011funun Kurum sa\u011fl\u0131k raporu ile saptanmas\u0131 gerekmektedir.<\/p>\n\n\n\n<p>Kanun\u2019un 14\u2019\u00fcnc\u00fc maddesinde; \u201cSigortal\u0131n\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 i\u015ften dolay\u0131 meslek hastal\u0131\u011f\u0131na tutuldu\u011funun;<\/p>\n\n\n\n<p>a) Kurumca yetkilendirilen sa\u011fl\u0131k hizmet sunucular\u0131 taraf\u0131ndan us\u00fbl\u00fcne uygun olarak d\u00fczenlenen sa\u011fl\u0131k kurulu raporu ve dayana\u011f\u0131 t\u0131bb\u00ee belgelerin incelenmesi,<\/p>\n\n\n\n<p>b) Kurumca gerekli g\u00f6r\u00fcld\u00fc\u011f\u00fc hallerde, i\u015fyerindeki \u00e7al\u0131\u015fma \u015fartlar\u0131n\u0131 ve buna ba\u011fl\u0131 t\u0131bb\u00ee sonu\u00e7lar\u0131n\u0131 ortaya koyan denetim raporlar\u0131 ve gerekli di\u011fer belgelerin incelenmesi, sonucu Kurum Sa\u011fl\u0131k Kurulu taraf\u0131ndan tespit edilmesi zorunludur.\u201d d\u00fczenlemesine yer verilmi\u015f,<\/p>\n\n\n\n<p>b\u00f6ylece meslek hastal\u0131\u011f\u0131n\u0131n kabul\u00fcnde Kurum Sa\u011fl\u0131k Kurulunun tespiti aranm\u0131\u015ft\u0131r.<\/p>\n\n\n\n<p>Nihayet hastal\u0131\u011f\u0131n ya da bedensel veya ruhsal engellilik h\u00e2linin meslek hastal\u0131\u011f\u0131 olarak nitelendirilebilmesi i\u00e7in aranan di\u011fer bir \u015fart sigortal\u0131n\u0131n beden veya ruh\u00e7a bir zarara u\u011framas\u0131d\u0131r. Sigortal\u0131n\u0131n \u00e7al\u0131\u015ft\u0131\u011f\u0131 veya yapt\u0131\u011f\u0131 i\u015fin niteli\u011finden dolay\u0131 tekrarlanan bir sebeple veya i\u015fin y\u00fcr\u00fct\u00fcm\u00fc sonucu meslek hastal\u0131\u011f\u0131na neden olan etkilerle kar\u015f\u0131la\u015fmas\u0131 elbette meslek hastal\u0131\u011f\u0131n\u0131n varl\u0131\u011f\u0131 i\u00e7in yeterli de\u011fildir. Ayn\u0131 zamanda ge\u00e7ici veya s\u00fcrekli hastal\u0131k, bedensel veya ruhsal engellilik h\u00e2linin de ortaya \u00e7\u0131kmas\u0131 gerekmektedir.<\/p>\n\n\n\n<p>Somut olayda, sigortal\u0131 M\u2026.\u2019\u0131n daval\u0131 Brisa Bridgestone Sabanc\u0131 Lastik San. ve Tic. A.\u015e.\u2019de lastik imalat operat\u00f6r\u00fc olarak \u00e7al\u0131\u015f\u0131rken y\u00fcr\u00fct\u00fclen i\u015fin sonucu olarak s\u00fcrekli elini kullanmas\u0131 nedeniyle rahats\u0131zland\u0131\u011f\u0131 ve ilk olarak 02.04.2008 tarihinde i\u015fyeri hekimine ba\u015fvurdu\u011fu, bunun \u00fczerine sigortal\u0131ya \u201csa\u011f leteral epikondilit\u201d te\u015fhisi konuldu\u011fu, daha sonra \u201csol kubital t\u00fcnel sendromu\u201d tan\u0131s\u0131yla 15.12.2008 tarihinde ameliyat edildi\u011fi, yine 14.04.2009 tarihinde \u201csa\u011f lateral epikondilit tan\u0131s\u0131yla\u201d ameliyata al\u0131nd\u0131\u011f\u0131, hastal\u0131\u011f\u0131 nedeniyle \u00e7e\u015fitli tarihlerde tedavi g\u00f6rd\u00fc\u011f\u00fc, son olarak \u0130stanbul Meslek Hastal\u0131klar\u0131 Hastanesinden al\u0131nan 13.11.2009 tarihli rapor ile \u201cbilateral lateral epondilit, kubital t\u00fcnel sendromu\u201d tan\u0131s\u0131 konuldu\u011fu, 20.08.2010 tarihli Sosyal Sigorta Y\u00fcksek Sa\u011fl\u0131k Kurulu karar\u0131nda M\u2026\u015f\u2019\u0131n hastal\u0131\u011f\u0131n\u0131n E-6 kodu ile meslek hastal\u0131\u011f\u0131 listesinde bulundu\u011fu ve mevcut hastal\u0131\u011f\u0131n\u0131n mesleki oldu\u011funun belirtildi\u011fi anla\u015f\u0131lmaktad\u0131r.<\/p>\n\n\n\n<p>Meslek hastal\u0131\u011f\u0131n\u0131n tan\u0131m\u0131 ve \u015fartlar\u0131na y\u00f6nelik verilen bilgiler \u0131\u015f\u0131nda somut olay de\u011ferlendirildi\u011finde, sigortal\u0131 M\u2026\u2019\u0131n mesle\u011fini icra ederken elini kullanmas\u0131 nedeniyle y\u00fcr\u00fct\u00fclen i\u015fin niteli\u011fi gere\u011fi hastal\u0131\u011f\u0131n vuku buldu\u011fu, e\u011fer sigortal\u0131, daval\u0131 i\u015fveren nezdinde lastik imalat operat\u00f6r\u00fc olarak \u00e7al\u0131\u015fmasa idi hastal\u0131\u011f\u0131n da ortaya \u00e7\u0131kmayaca\u011f\u0131, bu h\u00e2liyle i\u015fyeri ko\u015fullar\u0131 ile ortaya \u00e7\u0131kan hastal\u0131k aras\u0131nda uygun illiyet ba\u011f\u0131n\u0131n bulundu\u011fu a\u00e7\u0131kt\u0131r. H\u00e2l b\u00f6yle olunca sigortal\u0131 y\u00f6n\u00fcnden meslek hastal\u0131\u011f\u0131n\u0131n varl\u0131\u011f\u0131 i\u00e7in aranan t\u00fcm \u015fartlar ger\u00e7ekle\u015fmi\u015f oldu\u011fundan M\u2026\u2019\u0131n hastal\u0131\u011f\u0131n\u0131n meslek hastal\u0131\u011f\u0131 oldu\u011funun kabul\u00fc gerekmektedir (Yarg\u0131tay Hukuk Genel Kurulu &#8211; Karar : 2018\/1185).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Meslek Hastal\u0131\u011f\u0131 Nedir? \u015eartlar\u0131 Nelerdir?
